ORDINANCE NO. ~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A UTILITY EASEMENT LOCATED WITHIN THE SOUTHGATE
ADDITION TO THE CITY OF FORT WORTH, TEXAS, AS MORE SPE-
CIFICALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE llATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That, proper arrangements for the relocation of existing tele-
phone utility facilities having been made, the utility easement more
particularly described in Exhibit "A" which is attached hereto and
incorporated herein by reference for all purposes; said easement
being located on the Southgate Addition to the City of Fort Worth,
Texas, the plat of which is recorded in Volume 388-198, Page 1 of
the Plat Records of Tarrant County, Texas, be and the same is
vacated, abandoned and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

FIELD NOTES - _
Being a 5.00 foot wide utilities easement tract proposed to be va-
cated from Lot 32, Block 21 of Southgate, Phase I, an addition to
the City of Ft. Worth, Texas, as recorded April 16, 1886 in Volume
388-1q8, Page 1, Revised Map Records of Tarrant County, Texas;
said 5.00 foot wide easement being better described in accompanying
Exhibit "B" and by metes and bounds, as follows:
Commencing at a 1/2 inch iron rod found in the Northerly right-of-way
line of Delta Way, a 50-foot wide street; said iron rod occupying the
Southwest corner of said Lot 32;
THENCE: North 8q degrees 55 minutes 27 seconds East, 35.00 feet in
said Northerly right-of-way line of Delta Way to a point for corner,
and the PLACE OF BEGINNING of this tract;
THENCE: North 60 degrees 04 minutes 33 seconds West, 100.00 feet to
a point for corner;
THENCEi North 8q degrees 55 minutes 27 seconds East, 5.00 feet in
the common boundary line of Lots 32 and Lot 2 to a 1/2 inch iron rod
found for the Northeast corner of this easement tract and the North-
east corner of Lot 32;
THENCE: South 00 degrees 04. minutes 33 seconds East 100.00 feet to a
1/2 inch iron rod ound for corner in the Southeast corner of Lot 32,
Southeast corner of this tract and in said Northerly right-of-way
line of said Delta Way;
THENCE: South 8q degrees 55 minutes 27 seconds West, 5.00 feet in
said Northerly right-of-way line of Delta Way to the PLACE OF BE-
GINNTNG.
This tract contains 500.00 square feet of land (0.0115 acres).

It is recommended that the City Council adopt an ordinance vacating a
100' long X 5' wide utility easement, located in Lot 32, Block 21,
Southgate Addition, as recorded in Volume 388-198, Page 1, P.R.T.C.T.
DISCUSSION:
Elmer C. Coon, on behalf of McKinney Homes, owner of the subject
property, has requested that the City vacate the above described utility
easement, as defined in Exhibit A and shown on the attached map.
The subject easement, acquired by dedication is platted and contains a
telephone utility facility. Satisfactory arrangements have been made
for the relocation of said existing utility facility and the dedication
of an additional easement on Lot 31, Block 21, Southgate Addition. The
subject vacation is made in order to utilize the vacated easement as
part of the development of the subject property.
The Director of Real Property Management has determined that a $1.00
consideration fee satisfies the City of Fort Worth's interest in this
request.
Reviewing City departments and private utility companies have raised no
objection to this request, subject to any utility facilities being
relocated at the applicant's expense.
