AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND
TRAFFIC," OF THE CODE OF THE CITY OF FORT WORTH
(1986), AS AMENDED, BY AMENDING SUBSECTION (a) OF SEC-
TION 22-192 THEREOF ESTABLISHING PARKING METER
HOLIDAYS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMU-
LATIVE OF ALL PROVISIONS OF ORDINANCES AND OF SUCH
CODE AFFECTING MOTOR VEHICLES AND TRAFFIC; PROVIDING A
SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE:
PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Chapter 22, "Motor Vehicles and Traffic," of the Code of the
City of Fort Worth (1986), as amended, is hereby amended by amending
Subsection (a) of Section 22-192, and after such amendment, Subsection (a)
of Section 22-192 shall be and read as follows:
"Section 22-192. Hours meters to operate; information to be shown on
meters.
(a) Parking meters in the established zones shall regulate the
parking of vehicles between the hours of 8:00 A.M. and 6:00
P.M., unless otherwise specified by sign, of any day,
except Saturdays and Sundays; or when parking is
specifically prohibited by street sign.
In addition to Saturdays and Sundays, the following parking
meter holidays will be observed:
1. New Year's Day - January 1st
2. Martin Luther King Jr's Birthday - Third Monday in
January
3. Washington's Birthday - Third Monday in February
4. Memorial Day - Last Monday in May
5. Independence Day - July 4th
6. Labor Day - First Monday in September
7. Thanksgiving Day - Fourth Thursday in November
8. Thanksgiving Friday - Fourth Friday in November
9. Christmas Day - December 25th

When a parking meter holiday falls on Sunday and the
holiday is officially observed on the following Monday, the
parking meter holiday will be observed on Monday and when a
parking meter holiday falls on a Saturday and is officially
observed on the preceding Friday, the parking meter holiday
will be observed on Friday.
The City Council may also from time to time designate park-
ing meter holidays for special events or activities when
such action is in the best interest of the City."
SECTION 2.
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth (1986), as amended,
affecting motor vehicles and traffic, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances
and such Code, in which event such conflicting provisions of such
ordinances and such Code are hereby repealed.
SECTION 3.
That all rights or remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of the provisions of Chapter
22 of the Code of the City of Fort Worth (1986), as amended, and of any
other ordinance affecting motor vehicles and traffic which have accrued at
the time of the effective date of this ordinance; and, as to such accrued
violations and all pending litigation, both civil and criminal, whether
pending in court or not, under such chapter and/or other ordinances, same
shall not be affected by this ordinance but may be prosecuted until final
disposition by the courts.

SECTION 4.
That it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or
section of this ordinance shall be declared void, ineffective or un-
constitutional by the valid judgment or final decree of a court of com-
petent jurisdiction, such voidness, ineffectiveness or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation herein of any such
void, ineffective or unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 5.
That the City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption of same in the
minutes of the City Council of Fort Worth and by filing the ordinance in
the ordinance records of said City.
SECTION 6.
That this ordinance shall be in full force and effect from and after
the date of its passage and publication as required by law, and it is so
ordained.

RECOMMENDATION
It is~recommended that the City Council:
1 Include Martin Luther King, Jr.'s Birthday as a designated parking meter
•hol iday;
2. Include the Friday after Thanksgiving as a designated parking meter
holiday, and
3. Adopt the attached changes to Fort Worth City Code Section 22-192 to
include a paragraph specifically designating the annual parking meter
holidays in Fort Worth.
DISCUSSION
Parking meters are used in the Downtown area in order to regulate on street
parking and to encourage short term parking with high turnover so that downtown
retail and office customers do not have to compete with the CBD workforce all-
day parkers.
Last year citizens were confused because Martin Luther King, Jr.'s Birthday was
a City holiday but was not declared a parking meter holiday. Many citizens were
written citations because of parking on the meters without paying. Because of
the apparent confusion, the parking meter citations were dismissed. This
confusion also occurs on the Friday after Thanksgiving Day which is the biggest
Christmas shopping day of the year.
This year it is our desire to establish Martin Luther King, Jr.'s Birthday
and the Friday after Thanksgiving as parking meter holidays and to include
these holidays in the City Code along with other previously designated parking
meter holidays. The revised City Code provides that the City Council may from
time to time designate additional parking meter holidays for special events or
activities when such action is in the best interest of the City.
FISCAL
The revenue loss to the General Fund resulting from designating Martin Luther
King, Jr 's Birthday and Thanksgiving Friday as parking meter holidays will be
approximately $6,000.
