'_ ~ ~ ' AN ORDINANCE AMENDING SECTIONS 35-56(a), 35-56(b), 35-56(c) and 35-56(d) OF CHAPTER 35 OF THE CODE THE CITY OF FORT WORTH (1986), AS AMENDED, BY ADDING A DEFINITION AND REVISING CERTAIN RATES AND CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OFtTHE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 35-56(a) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended by adding the following definition: "NONRESIDENTIAL CUSTOMER CLASS shall consist of the industrial customer class and the commercial customer class." SECTION 2. That Section 35-56(b) of Chapter 35 of the Code of the City of Fort worth (1986), as amended, be~and the same is hereby amended and, after having been amended, shall be and read as follows: "(b) The following schedule of rates per month, or fraction thereof, shall be the charges to all residential and -1- nonresidential customers for furnishing water to such customers located within the city. The residential monthly volume charge for water service shall be the charges to the residential customers class, as defined in this chapter, for furnishing water to residential water customers located within the city. The nonresidential monthly volume charge for water service shall be the charges to the nonresidential customer class, as defined in this chapter, for furnishing water to nonresidential water customers located within the city. That Section 35-56(c) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows: "(c) The following schedule of rates per month or fraction thereof shall be the basis for determining charges to all customers for rendering sanitary sewerage service, where the sewage produced by such customer is a normal strength waste water two hundred ten (210) mg/1 B.O.D. and two hundred forty (240) -3- mg/1 suspended solids) and where such customer is located within the city: RATES FOR SEWERAGE SERVICE ONLY (1) A monthly service charge shall be charged to all customers in the amount of four dollars and fifty cents ($4.50). (2) A monthly volume charge shall also be charged to all customers in the amount of six hundred and sixty-eight thousandths of a dollar ($0.668) per one hundred (100) cubic feet of water used, or waste water produced, as more specifically set forth hereinafter." "The monthly volume charges for residential class customers will be based on the individual customer's average monthly water use during the preceding winter quarter months of December, January and February. The volumes used to compute these charges are based on the amount of water used by the residential class customer as measured by a meter. Where no preceding winter quarter average is available from records, the director shall estimate a volume to be used for this monthly volume charge." -4- "The monthly charges to commercial and industrial class customers will be based on total water use as measured by appropriate meters, with the provision that if a customer can show, to the satisfaction of the director of the water department, that a significant portion of the metered water usage does not enter the sanitary sewers, the customer will be charged for only that volume entering the sewers, as determined by a method approved by the director." SECTION 4. That Section 35-56(d) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having amended, shall be and read as follows: "(d) The director of the water department shall establish a monitored group class, consisting of those customers whose waste water strength is, in his judgment, abnormally high or whose waste water contains limited substances or materials, and charges to customers in this class shall be computed in accord with the following five part rate schedule: MONITORED GROUP Customer monthly service charge $4.50 Volume charge, per 100 cubic feet $0.487 -5- B.O.D. strength charge, per pound of B.O.D. $0.087 Suspended solids strength charge, $0.046 per pound of suspended solids Monitoring and pretreatment charge Total actual cost" "The monitoring charge shall consist of all cost for personnel, material and equipment used to collect and analyze samples from the customer waste water to determine the strength of the waste water produced and, when appropriate, to inspect pretreatment facilities, to administer pretreatment permit systems and to enforce ordinance requirements. Pretreatment requirements primarily affect industries which discharge toxic substances into the sewerage system." '°This schedule shall replace all other charges previously made for industrial waste strength." SECTION 5. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended,. except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinanc- es and such Code are hereby repealed. -6- r SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sen- tences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorpora- tion in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -7- •. .. ., .. That this ordinance shall become effective and be in full force and effect from and after its passage; provided, how- ever, that the increased rates specified herein shall apply to residential and nonresidential utility statements sent by the City of Fort Worth on or after October 1, 1988, and it is so ordained. DISCUSSION Since the last water and sewer rate increases two years ago, debt service, raw water coy*s, and other operation and maintenance costs have continued to increase. T~ major water expenditures, raw water costs and debt service, are expected to increase by $14,574,813 (157) and $2,063,001 (24~) respectively over 1986 actual expenditures. Regarding major sewer expenditures, debt service is expected to increase by $3,932,403 (41~) over 1986 actual expenditures. Without a rate increase to offset the increased costs in the FY 87/88 budget, the projected combined deficit for this year is $10.7 million. Although increased sales would reduce the deficit to $9.3 million in 1989,. the large on-going wat~~ and sewer CIP program is expected to continue to drive up debt service and operation and maintenance costs in the coming years. The proposed 1989 water and sewer budget reflects every effort to restrain costs, including delaying the issuance of bonds for the construction of the Eagle Mountain Lake Water Treatment Plant and related projects until 1990, and the intent to obtain low interest State revolving fund loans for Village Creek Wastewater T reatment Plant expansion projects. Water and sewer operating fund reserves are not ade- quate to offset the need for FY 1989 water and sewer rate increases. The Water Department staff conducted a water cost of service study and present- ed water and sewer rate increase recommendations to the !"ouncil Rate Committee on June 15, 1988. Since this initial meeting the Watc Department budget has been revised and alternative rate structures were discussed at a meeting with the rate committee held on July 5, 1988. As a result of these discussions with the rate committee, water and sewer increases of 19.2 and 4.5~, respectively are recommended.
