QO'JJI~ AN ORDINANCE AMENDING CHAPTER 16, "HEALTH AND SANITATION", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, BY AMENDING SECTION 355(A)(3) TO INCLUDE A NEW FEE CATEGORY TO THE FEE SCHEDULE, PROVIDING A FEE FOR TEMPORARY FOOD SERVICE ESTABLISHMENTS SELLING ONLY NON- POTENTIALLY HAZARDOUS BEVERAGES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OR PROVISIONS OF CHAPTER 16 OF THE CODE OF THE CITY OF FORT WORTH; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF TliE CITY OF FORT WORTH, TEXAS: SECTION 1. That a Section 16-355(a)(3)(c) be and hereby is added to Chapter 16 of the Code of the City of Fort Worth, Texas (1986), to read as follows: "Open beverage (non-potentially hazardous) stands operated at special events by the designated Special Events Coordinator - $25.00 for the first day, plus $5.00 for each additional day, plus $5.00 per booth per day." SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sections, para- ..„, ,2 - ~~, graphs, sentences, clauses and phrases of this ordinance are sever- able and if any section, paragraph, sentence, clause or phrase of this ordinance shall be declared void, ineffective or unconstitu- tional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, paragraphs, sen- tences, clauses or phrases of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional section, paragraph, sentence, clause or phrase. SECTION 4. Th e City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as pro- vided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 5. The City Secretary of the City of Fort Worth, Texas, is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -2- ~., ., .!3 o v :, SECTION 6. t ~:.~ This ordinance shall be in full force and effect from and after the date of passage and publication as above specified. REFERENCE NUMBER suB~ECT PROPOSED AMENDMENT TO CITY PAGE 1/19/88 CODE CHAPTER 16, "HEALTH AND ~1 1 of G-7413 ~~ _ _ TEMPORARY FOOD STANDS Recommendation It is recommended that the City Council approve the following amendment to the City Code Section 16-355 (a) (3) to create the following new fee category as Subsection (c)+ NO CHANGE (a) Temporary food stands or vendor - $25.00 for the first day plus $5 00 for each additional day, NO CHANGE (b) All temporary food stands at an event open only to members of the organization conducting the event and their families and not the general public - $150 00, ADD (c) Temporary food service establishments - Open beverage (non-potentially hazardous) stands operated at special events by the designated Special Event Coordinator - $25.00 for the first day plus $5.00 for each additional day PLUS $5.00 per booth Discussion On August 6, 1985 (M&C G-6402), City Council adopted ordinances and administrative changes necessary to implement proposed user fee adjustments. These adjustments were based on the November, 1982 City-wide analysis of user fees and service charges conducted by David M Griffith and Associates. Based on the study, the fee charged to temporary food stands was changed from $50.00 to $25.00 for the first day plus $5 00 for each additional day. This fee change has created a fee assessment that is not proportionate for the amount of time spent in inspection of open non-potentially hazardous beverage stands. To apply the fee for temporary food establishments in Special Events fairly, an additional category has been proposed providing for temporary stands (open non-potentially hazardous beverage only) to be permitted at $25.00 for the first day plus $5 00 for each additional day plus $5.00 for each additional booth operated by the the Special Event Coordinator.
