HomeMy WebLinkAboutOrdinance 10147~~ ~: sa ORDINANCE NO. ~~~~~$~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING AN ALLEY LOCATED WITHIN THE BROOKS AND BAILEY SUBDIVISION OF THE FIELD'S WELCH ADDITION OF THE CITY OF FORT WORTH, TEXAS, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT, proper arrangements for the relocation of existing sewer, electric, gas, and telephone utilities having been made; the twelve (12) foot wide by fifty (50) foot long north/south alley located between Lots 1 and 2 on the east and Lot 14R on the west of Block 1/25 of the Brooks and Bailey Subdivision of the Field's Welch Addition to the City of Fort Worth, Texas, as recorded in Volume 388-174, Page 52, of the Deed Records of Tarrant County, Texas, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land(s) in the above describ ed vacated public alley and right-of-way is hereby released and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and ali existing and prospective drainage require- meats as necessary. Alston Avenue (V-86-25) COMMENDATION It is recommended that the City Council adopt an ordinance vacating the 12' wide X 50' long north/south alley located between Lots 1 and 2, and 14R, Block 1/25 of the Brooks and Bailey Subdivision of Field's Welch Addition, as recorded in Volume 388-174, Page 52, D.R.T.C T., as recommended by the City Plan Commission. DISCUSSION. The Director of Planning with consent of all abutting property owners, has requested the City to vacate the above described alley right-of-way, as shown on the attached map. The subject alley right-of-way, acquired by dedication, presently contains sewer, electric, gas, and telephone utility facilities. The subject vacation request is made in order to replat the vacated alley right-of-way with adjacent property, to expand the building area and provide more usable yard space. The required and appropriate monetary consideration, Six Hundred Dollars ($600 00), has been placed in escrow with the Real Property Department as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being rellatted with adjacent property, and any required utility easements being retained or relocated at the applicant's expense. A satisfactory replat has been submitted.
