HomeMy WebLinkAboutOrdinance 10053 ORDINANCE NO.~GiUv AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A 15 FOOT WIDE SANITARY SEWER EASEMENT LOCATED IN THE JOHN PETER SMITH HOSPITAL SITE; SAID EASEMENT BEING MORE SPECIFICALLY DESCRIBED HEREIN; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. 'T'HAT THE 15 foot wide sanitary sewer easement located on the John Peter Smith Hospital site and being more specifically described in Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained . R. T. C.T. Di scussi-on Tarr ant~'"County Hospital District, operator of John Peter Smith Hospital and owner o~ the subject property, have requested that the City vacate the above described utility easement as shown on the attached map. The subject utility easement acquired by dedication presently contains a sewer line. The subject vacation request is made in order to replat the vacated utility easement with adjacent property to expand the building area and provide more usable space. The required and appropriate monetary consideration has been paid to the Real Property Department, as required by the Land Agent of the City of Fort Worth. The reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated utility easement being replatted with adjacent property and relocated at the applicant's expense A satisfactory replat has been submitted that includes this rededication and relocation.
