AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A PORTION OF MAY STREET ADJACENT TO AND BETWEEN
THE W.A. TAYLOR, J.M. VINCENT, AND W.P. PATILLO'S ADDI-
TIONS TO THE CITY OF FORT WORTH, TEXAS; SAID PORTION BEING
MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVER-
SION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT THE portion of May Street located between and adjacent to
Lot 1, Block 1 of the W.A. Taylor Addition, as recorded in Volume
388-93, Page 408 of the Plat Records of Tarrant County, Texas; and
Block 2 of the J.M. Vincent Addition, as recorded in Volume 62,
Page 109 of the Plat Records of Tarrant County, Texas, and Block 4
of the Goldsmith's Subdivision of W.P. Patillo's Addition, as re-
corded in Volume 106, Page 68 of the Plat Records of Tarrant County,
Texas, said portion of May Street also lying between West Allen
Street Avenue and West Myrtle Street, be and the same is vacated,
abandoned, and permanently closed and extinguished.
SECTION 2.
That the fee to the land(s) in the above described vacated
public street and right-of-way is hereby released and shall revert
to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that
easements are retained for any and all existing and prospective
utilities and all existing and prospective drainage requirements, as
necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

u'~"`' It ~is--r-e~commended that the City Council adopt an ordinance vacating May Street
(45~' --.right-of-way) from West Allen Avenue to West Myrtle Street, located
adjacent to and between Lot 1, Block 1, W. A. Taylor Addition, as recorded in
Volume- 388-93, Page 408, and J. M. Vincent Addition, Lots 1-10, Block 2, as
recorded in Volume 62, Page 109 and Lots 11-24, Block 4, Goldsmith's
Subdivision of Blocks 3, 4 and 5 of W. P. Patillo's Addition found in Volume
106, Page 68, all of P.R.T.C.T., as recommended by the City Plan Commission.
It is further recommended that the City Council adopt an ordinance vacating a
12' wide alley located in Block 4, between and adjacent to lots 1-20 of
Goldsmith's Subdivision as recorded in -•Volume 106, Page 68, P.R.T. C.T., as
recommended by the City Plan Commission.
Discussion
The Tarrant County Hospital District, operator of John Peter Smith Hospital and
owner of abutting property, has requested the City to vacate the above
described street and alley rights-of-way, as shown on the attached map.
The subject street right-of-way acquired by dedication presently contains sewer
and water utility facilities. The subject vacation request is made in order to
replat the vacated street right-of-way with adjacent property to expand the
building area and provide more usable yard space. The vacated street
right'-of•way will. be repsatted as a utility easement.
The subject alley right-of-way acquired by dedication presently contains sewer
and water utility facilities. The subject vacation request is made in order to
replat the vacated alley right-of-way with adjacent property to expand the
building area and provide more usable yard space.
It is noted that the Plan Commission has stipulated that May Street should
remain physically open on the ground until West'Myrtle Street, between May
Street and 3ennings Avenue, has been improved and opened for the public use.
This condition has been made a requirement of the replat. submitted- with this
application,

The required and appropriate monetary consideration of $1.00 in exchange for
certain street right-of-way dedications has been placed in escrow with the Real
Property Department, as required by the Land Agent for the City of Fart Worth.

Reviewing city departments and private utility companies have raised no
objections to this request, subject to the vacated rights-of-way being
replatted with adjacent property, and any required utility easements retained
and/or relocation of existing utilities at the applicant's expense." A
satisfactory replat has been submitted.
