AN ORDINANCE AMENDING SECTION 35-56(b), AND SECTION 35-57(a), OF CHAPTER 35 OF THE CODE THE CITY OF FORT WORTH (1986)., AS AMENDED, BY REVISING CERTAIN WATER RATES AND CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 35-56(b) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and is hereby amended and, after been so amended, shall hereafter read and be as follows: "(b) The following schedule of rates per month, or fraction thereof, shall be the charges to all residential and nonresidential customers for furnishing water to such customers located within the city. The residential monthly volume charge for water service shall be the charges to the residential customers class, as defined in this chapter, for furnishing water to residential water customers located within the city. The nonresidential monthly volume charge for water service shall be the charges to the nonresidential customer class, as defined in -1- this chapter, for furnishing water to nonresidential water customers located within the city. SECTION 2. That. Section 35-57(a) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows: "(a) A minimum charge per month, or fraction thereof, shall be made for each connection with the water mains or sewer mains of the city waterworks. This charge shall be based on the size of the meter through which water is furnished regardless of source and shall be as follows: -3- .. 1. ' SCHEDULE A. WATER SERVICE ONLY The minimum monthly charge shall be equal to and be the same as the monthly service charge contained in section 35-56(b) of this chapter. The monthly charges for connections to unmetered, automatic sprinkler system, or other fire lines installed and used for fire protection shall be as set out in the chart under Schedule A above. Charges for sizes larger than ten (10) inches will be determined by the director of the water department. When it is determined that water has been or is being used through or from an unmetered automatic sprinkler system for purposes other than for fire fighting, the customer shall pay the full cost of a meter installation on the fire line. -4- All fire protection systems used exclusively for fire-fighting purposes and provided with outlets other than standard closed sprinkler heads shall be provided with detector-type check valves at customer's cost before connection with the water mains of the city. In case it is determined that water is used through such detector check valves for purposes other than for fire fighting, the detector check valve installation shall be replaced with a standard meter with the consumer paying the full cost of the meter installation. (2) METER SIZES. Only one tl) five-eighths-inch by three- fourths-inch meter shall be attached to and served by a three-fourths-inch tap. No more than two (2) five-eighths- inch by three-fourths-inch or one (1) one-inch meter shall be attached to and served by a one-inch tap. Not more than one (1) one-and-one-half-inch or three (3) five-eighths-inch by three-fourths-inch or three (3) one-inch meters shall be attached to and served by a one-and one-half-inch tap. Not more than one (1) two-inch, four (4) one-inch or six (6) five-eighths by three-fourths-inch meters shall be attached to and served by a two-inch tap. (3) SEASONAL METERS. Customers using a separate water 'meter for one (1) or more seasonal purposes (such as lawn watering, -5- ~# Z ~ but not being limited thereto) shall pay the minimum monthly charge prescribed in this section for each meter throughout the year, whether such service is active or not. If such service is disconnected at the request of the customer and the customer requests that the service be reconnected within the next twelve (12) months, a reconnection charge shall be paid equivalent to the monthly minimum charge times the number of months that such service has been disconnect- ed." SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinanc- es and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality -6- shall not affect any of the remaining phrases, clauses, sen- tences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorpora- tion in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 6. That this ordinance shall become effective and be in full force and effect from and after its passage; provided, how- ever, that the increased rates specified herein shall apply to residential and nonresidential utility statements sent by the City of Fort Worth on or after October 1, 1988, and it is so ordained. The Fort Worth Water Department also furnishes untreated water to a few raw water customers and emergency service to customers owning private fire protection systems (fireline customers). Setting appropriate rates for these services required knowing the cost of untreated water to be supplied by Tarrant County Water Control and Improvement District No. 1. In mid-August, the District furnished Fort Worth with its proposed budget and rates.
