HomeMy WebLinkAboutOrdinance 10075 ORDINANCE NO. ~p~ AN ORDINANCE AMENDING CHAPTER 35, "WATER AND SEWERS", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, BY AMENDING SUBSECTION (b) OF SECTION 35-57, CONNECTION CHARGE, TO PROVIDE FOR A WATER TAP REDUCTION CHA RGE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OR PROVISIONS OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Subsection (b) of Section 35-57, "Water and Sewers", of the Code of the City of Fort Worth, Texas (1986), as amended, be, and is hereby, further amended to be and read as follows: "(b) A charge shall be made by the city water depart- ment for each tap made to a water main for a connection, which charge shall be determined by the size of the con- nection and the character of the surface of the street in which the connection is to be located. From the following schedule shall be determined the charge for making taps, and the charge shall be payable in advance: WATER INSTALLATION CHARGE Paved Street (Concrete, H.M.C.A., Tap size Unimproved Flexible Base or (inches) Street Penetration) 3/4 $ 550.00 $ 775.00 1 550.00 775.00 1-1/2 575.00 850.00 2 600.00 900.00 For each 3/4-inch branch, add $85.00. For each 1-inch branch, add $110.00. ~~ ~;, ~, s Any water connection larger than two (2) inches shall be made under contract between the customer and the City. Total material and installation costs of the tap and meter or meters, including multiple meter settings instead of a three-inch or larger meter setting, shall be paid by the customer. Payment shall be based on the cost estimated by the Water Department, acting by and through the Director of the Water Department. Developers will pay the full cost of all water service taps constructed by contract in new developments. All water meters connected directly to the City's water system on and after the effective date hereof shall be the property of the City. "A property owner may request that the water meter providing service to the owner's property be reduced in size. A charge shall be made by the City Water Department for each reduction of size of the water meter. The charge to be made for water meter reduction shall be based on the following schedule, and the charge shall be payable in advance WATER METER REDUCTION Size Reduction Charge 1" to 3/4" $40.00 1-1/2" to 3/4" $70.00 1-1/2" to 1" $70.00 2" to 1-1/2" $90.00 2" to 1" $90.00" SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of -2 - ., 5~ 0 this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Section 1 in the minutes of the City Council and by filing the ordi- nance in the ordinance records of the City. SEC'T'ION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Discussion On October 13, 1987 (M&C G-7286), the City Council approved Ordinance No. 9982 which revised downward adjustment of water tap fees and revised upward adjustment of sewer tap fees. The attached ordinance amends Ordinance No. 9982 by providing a recommended water meter size reduction fee schedule. These fees are based on the cost of one route person and a pickup truck for one hour plus material to complete the changeover.
