ORDINANCE NO. ~ao~1 ~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A PORTION OF A UTILITY AND DRAINAGE EASEMENT, AS MORE SPECIFICALLY DESCRIBED HEREIN, LOCATED IN THE CALMAR COURT ADDITION TO THE CITY OF FORT WORTH, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT O RDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, 'TEXAS: SECTION 1. 1 THAT THE portion of the utility and drainage easement, more k specifically described i~ Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes, located in Lot 13, Block 1 of the Calmar Court Addition to the City of Fort Worth, Texas, said addition being recorded in Volume 388-109, Page 99 of the Plat Records of Tarrant County, Texas, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. LOT 13 - CALMAR COURT, SOUTH 0 ) °f____.__ MONTERREY DRIVE Recommendation It is recommended that the City Council adopt an ordinance vacating a portion of a utility and drainage easement, as further described in Exhibit A, located in Lot 13, Block 1, Calmar Court Addition, as recorded in Volume 388-109, Page 99, P.R.T.C.T Discussion Ms. Ruth A. Whitney, owner of the subject property, has requested that the City ' vacate a portion of the above described utility and drainage easement, as shown on the attached map, Exhibit B. The subject easement, acquired by dedication, is platted and contains a sewer utility facility and a storm drainage line. Reviewing City departments have determined that vacation of the requested portion of the storm drainage and utility easement would not effect the utility facilities. The subject vacation request is made in order to utilize the vacated easement as part of the subject property for construction of the applicant's residence.
