ORDINANCE NO. ~ao~1 ~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A PORTION OF A UTILITY AND DRAINAGE EASEMENT, AS
MORE SPECIFICALLY DESCRIBED HEREIN, LOCATED IN THE CALMAR
COURT ADDITION TO THE CITY OF FORT WORTH, TEXAS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
BE IT O RDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, 'TEXAS:
SECTION 1.

THAT THE portion of the utility and drainage easement, more

specifically described i~ Exhibit "A" which is attached hereto and
incorporated herein by reference for all purposes, located in
Lot 13, Block 1 of the Calmar Court Addition to the City of Fort
Worth, Texas, said addition being recorded in Volume 388-109,
Page 99 of the Plat Records of Tarrant County, Texas, be and the
same is vacated, abandoned, and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

LEGAL DESCRIPTION
FOR A
PORTION OF A 22.5 F00T WIDE DRAINAGE AND UTILITY EASEMENT
BEING 294 square feet of land located within Lot 13, Block 1, CALMAR COURT
ADDITION to the City of Fort Worth, Tarrant County, Texas, according to the
plat recorded in Volume 388-109, Page 99 of the Plat Records of Tarrant County,
Texas and being more particularly described by metes and bounds as follows:
BEGINNING at a point lying N 89° 42' W 49.00 feet; thence S 31° 04' 36' E
28.11 feet from the Northeast corner of said Lot 13, 81ock 1;
THENCE S 01°'08' 12" E 9.92 feet to a point on the corner of a brick house;
THENCE S 00° 46' S7" W 12.00 feet along the wall line of said brick house
to a point on the corner thereof,
THENCE S 09° 33' 43" W 26.21 feet to a point on the corner of said brick
house;
THENCE S 37° 06' 07" W 18.74 feet to a point on the corner of said brick
house;
THENCE N 89° 13' 03" W 0.18 feet along the wall line of said brick house to a
point;
THENCE N 14° 09' 00" E 64.66 feet along the West line of the aforesaid 22.5
foot wide drainage and utility easement to THE PLACE OF BEGINNING
containing 294 square feet of land.
NOTE: THE INTENT OF THIS EASEMENT IS 1VOT TO PROTRUDE

Recommendation
It is recommended that the City Council adopt an ordinance vacating a portion
of a utility and drainage easement, as further described in Exhibit A, located
in Lot 13, Block 1, Calmar Court Addition, as recorded in Volume 388-109, Page
99, P.R.T.C.T
Discussion
Ms. Ruth A. Whitney, owner of the subject property, has requested that the City
' vacate a portion of the above described utility and drainage easement, as shown
on the attached map, Exhibit B.
The subject easement, acquired by dedication, is platted and contains a sewer
utility facility and a storm drainage line. Reviewing City departments have
determined that vacation of the requested portion of the storm drainage and
utility easement would not effect the utility facilities. The subject vacation
request is made in order to utilize the vacated easement as part of the subject
property for construction of the applicant's residence.
The Director of Real Property Management has determined that a $1.00
consideration fee satisfies the City of Fort Worth's interest in this request
Reviewing City departments and private utility companies have raised no
objections to this request
