AN ORDINANCE AMENDING PARAGRAPH (a) OF SECTION 2-26
"COPYING, TYPING MATERIALS; FEE," IN ARTICLE II "CITY
SECRETARY," OF CHAPTER 2 "ADMINISTRATION" OF THE CODE OF
THE CITY OF FORT WORTH (1986), AS AMENDED, TO PROVIDE THAT
THE CITY SECRETARY MAY CHARGE FEES FOR RESEARCHING, LOCAT-
ING, PREPARATION AND COPYING OF PUBLIC RECORDS AND PUBLIC
INFORMATION AS PROVIDED BY THE REGULATIONS AND LAWS OF THE
STATE OF TEXAS GOVERNING SUCH FEES; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF OTHER ORDINANCES AND CODE
PROVISIONS AND REPEALING ORDINANCES AND CODE PROVISIONS IN
CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PRO-
VIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That paragraph (a) of Section 2-26 "Copying, typing materials;
fee," in Article II "City Secretary" of Chapter 2 "Administration"
of the ~ Code of the City of Fort Worth, Texas (1986) , as amended, is
amended to read as follows:
See. 2-26. Copying, typing materials; fee.
(a) The city secretary .may charge fees for research-
in~, locating, preparation and copying of public records
and public information as provided by the regulations and
laws of the State of Texas governing such fees, as same
may be amended from time to time. In addition, the follow-
ing fees may be charged for the typing of any papers:

If any of the above papers are to be mailed by the City
Secretary, a one-dollar handling fee and a fee for postage
will be charged.

SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1986), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed so far as they conflict with the provisions of
this ordinance.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption,
Sections 1 and 5 in the minutes of the City Council and by filing
the ordinance in the ordinance records of the City.

SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

PHOTOCOPYING PUBLIC RECORDS
Recommendation
It is recommended that an ordinance be adopted amending Chapter 2, Article II,
Section 2-26 of The Code of the City of Fort Worth, Texas (1986), as .amended, to
allow the City Secretary to charge fees for locating, preparing and photocopying
the public records, such fees to be consistent with those fees set by the Texas
State Purchasing and General Services Commission.
Background
Ordinance No 8269 was adopted by the City Council on February 17, 1981. The
ordinance allowed the City Secretary to charge a person requesting public
records $0 55 for the first page copied and $0 15 for each additional page
copied Excluded from these charges are the charges to City officials who need
copies to be used for City duties.
Periodically, the Texas State Purchasing and General Services Commission reviews
the costs involved in photocopying public records. The Commission issues
regulations that apply to photocopying of public records.
Recently, the Commission adopted new regulations for prices for researching,
locating, preparing and photocopying of public records. The regulation includes
prices for readily-available information on standard size paper as well as
guidelines for non-standard size pages (computer printouts, microfilm records,
etc ). The new regulation allows charges to be made for the time of the
employee doing the research For information not readily available, actual
labor costs for locating and preparing the information can be charged.
Ordinance No 8269 stated the maximum amount that could be charged. The new
ordinance, if adopted, will allow the City Secretary to charge for copies as
regulated by State Law and will allow for fluctuation in changes of fees without
the necessity of returning to the City Council for a new ordinance authorizing
new fees

for page 1, $0.15 per page thereafter;
(3) For any quantity of information deemed not readily available -
$0.70 for page 1, $0.15 per page thereafter, plus actual labor
costs for locating and preparing the information (employee time
multiplied by employee salary).

Actual cost of preparation, in consultation with the State Purchasing
and General Services Commission. Adequate cost data for this
consultation consists of the specific cost components of an individual
charge including, but not limited to, labor hours and rates, computer
time and rates, costs for materials such as computer tapes, paper,
fiche, cassettes, and printer supplies, and applied overhead by
component and application base.
