AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS WHO OWN TAXABLE PROPERTY IN THE CITY OF FORT WORTH,
TEXAS, AND WHO HAVE DULY RENDERED THE SAME FOR TAXATION FOR
THE PURPOSE OF DETERMINING UPON THE ISSUANCE OF REVENUE BONDS
IN THE SUM OF TWELVE MILLION, FOUR HUNDRED THOUSAND DOLLARS
($12,400,000.00) FOR THE PURPOSE OF IMPROVING, EXTENDING AND
ENLARGING THE WATERWORKS SYSTEM OF SAID CITY, SAID BONDS TO
BE ISSUED AT ONE TIME OR IN INSTALLMENTS FROM TIME TO TIME
AS THE CITY COUNCIL SHALL DETERMINE, THE BONDS OF EACH IN-
STALLMENT BEING PAYABLE SERIALLY AS MAY BE DETEILNINED BY THE
CITY COUNCIL, SO THAT THE LAST MATURING BONDS SHALL BECOME PAY-
ABLE WITHIN FORTY (40) YEARS FROM THE DATE THEREOF, AND BEAR-
ING INTEREST AT A RATE NOT TO EXCEED FOUR PER CENT (4%) PER
ANNUM FROM THE DATE THEREOF; AND TO DETERMINE UPON THE ISSU-
ANCE OF REVENUE BONDS IN THE SUM OF FIVE MILLION, SIX HUNDRED
THOUSAND DOLLARS ( 5,600,000.00) FOR THE PURPOSE OF IMPROVING,
EXTENDING AND ENLARGING THE EXISTING SEWER SYSTEM OF SAID CITY,
SAID BONDS TO BE ISSUED AT ONE TIME OR IN INSTALLMENTS FROM
TIME TO TIME AS THE CITY COUNCIL SHALL DETERMINE, THE BONDS
OF EACH INSTALLMENT BEING PAYABLE SERIALLY AS MAY BE DETERMINED
BY THE CITY COUNCIL, SO THAT THE LAST MATURING BONDS SHALL BE-
COME PAYABLE WITHIN FORTY (40) YEARS FROM THE DATE THEREOF,
AND BEARING INTEREST AT A RATE NOT TO EXCEED FLOUR PER CENT
(4%) PER ANNUM FROM THE DATE THEWF; AUTHORIZING THE ISSUANCE
OF THE BONDS SUPPORTED BY A COMBINED PLEDGE OF THE REVENUES
OF BOTH SYSTEMS; PLEDGING THE REVENUES OF THE WATERKORKS SYS-
TEM AND THE SEWER SYSTEM FOR THE PAYMENT THEREOF, IN ACCORDANCE
WITH THE PROVISIONS OF APPLICABLE STATUTES, AND PARTICULARLY
ARTICLES 1111-1118, BOTH INCLUSIVE, OF THE REVISED STATUTES
OF TEXAS, 19259 AS AMENDED, SAID ELECTION TO BE HELD IN THE
CITY OF FORT WORTH, TEXAS, ON TUESDAY, THE 25TH DAY OF JANUARY,
A. D. 1949; AND ORDAINING OTHER PROVISIONS RELATED TO THE
SUBJECT,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That a special election be held in the City of Fort Worth, Texas,
on Tuesday, the 25th day of January, A. D. 1949, at the polling places
hereinafter described, between the hours of seven o'clock A. M., and seven
o'clock P. M., at which election the following propositions for the issu-
ance of bonds of the City of Fort Worth, Texas, each and all of which
propositions contain a purpose clause that has been found and determined
by the City Council to be permanent public improvements and for a legiti-
mate public municipal purpose, shall be submitted to the qualified electors
who own taxable property in said City and who have duly rendered the same
for taxation in accordance with the provisions of Article 6, Section 3-kp
of the Texas Constitution as adopted at an election held on November 8,
A. D. 1932:
PROPOSITION N0. 1
Shall the City of Fort Worth, Texas, through its City Council, is-
sue its negotiable coupon bonds in the principal sum of Twelve Million,
Four Hundred Thousand Dollars ($12,400,000,00) for the purpose of improv-
ing, extending and enlarging the Waterworks System of said City, said
bonds to be issued at one time or in installments from time to time as
the City Council shall determine, the bonds of each installment being pay-
able serially as may be determined by the City Council, so that the last
maturing bonds shall become payable within forty (40) years from the date
thereof, and bearing interest at a rate not to exceed four per cent (4%)
per annum from the date thereof, payable semi-annually, and to provide
for the payment of principal and interest on said bonds by pledging the
net revenues from the operation of the Waterworks System of said City,
or in the event that the City Council be authorized to Issue Sewer System
revenue bonds as submitted in Pro22sition No, 2, to be secured additionally
by a pledge of the net revenues from the operation of said Sewer System?
PROPOSITION NO. 2
Shall the City of Fort Worth, Texas, through its City Council, is-
sue its negotiable coupon bonds in the principal sum of Five Million, Six
Hundred Thousand Dollars ($5,600,000.00) for the purpose of improving,
extending and enlarging the existing Sewer System of said City, said bonds
to be issued at one time or in installments from time to time as the City
Council shall determine, the bonds of each installment being payable
serially as may be determined by the City Council, so that the last mature•
ing bonds shall become payable within forty (40) years from the date there-
of, and bearing interest at a rate not to exceed four per cent (4%) per an-
num from the date thereof, payable semi-annually, and to provide for the
payment of principal and interest on said bonds by pledging the net revs*-
aaea from the operation of the Sewer System of said City, or in the event
that the City Council be authorized to issue Waterworks System revenue
bonds as submitted in Proposition No. 1, to be secured additionally by a
pledge of the net revenues from the operation of said Waterworks System?
SECTION 2*
That said election shall be held at the following places with the

SECTION 3,
That said election shall be held under the provisions of the Con-
stitution and laws of the State and, insofar as the same may be applicable,
the provisions of the Charter of the City of Fort Worth, Texas, and quali-
fied voters who own taxable property in said City and who have duly ren-
dered the same for taxation shall be allowed to vote upon said propositions,
and all electors shall vote in the election precinct of their residence,
SECTION 4.
Each proposition for the issuance of said bonds shall be separate
and distinct so that the voters shall pass upon each one separately and
apart from the others,
All voters who favor the proposition to issue the Waterworks System
revenue bonds shall have written or printed upon their ballots the words:
"FOR the issuance of Waterworks System Revenue Bonds,"
and those opposed shall have written or printed upon their ballots the
words.-
"AGAINST
ards:"AGAINST the issuance of Waterworks System Revenue Bonds;
All voters who favor the proposition to issue the Sewer System reve-
nue bonds shall have written or printed upon their ballots the words.-
"FOR
ords:"FOR the issuance of Sewer System Revenue Bonds,"
and those opposed shall have written or printed upon their ballots the
words:
"AGAINST the issuance of Sewer System Revenue Bonds."
SECTION 5•
The City Secretary is hereby ordered and directed to prepare and
issue ballots and stamp same "Official Ballot," on which ballots shall be
printed the propositions as set forth above.
SECTION 6,
In the event the said revenue bonds are authorized to be issued by
a majority vote of the qualified electors of said City voting at said
election, and the same are issued and sold, the holder or holders of such
revenue bonds shall never have the right to demand payment thereof out of
any funds raised or to be raised by taxation, and each bond issued or ex—
ecuted in pursuance of such election shall contain this clause:
"The holder hereof shall never have the right to
demand payment of this obligation out of any funds
raised, or to be raised, by taxation."
SECTION 7,
The City of Fort Worth expressly reserves the right to issue and
sell the total authorization of Eighteen Million Dollars ($18,000,000.00)
in bonds if both propositions are approved by the qualified voters, in one
or more installments, and in the event the bonds, as authorized, are not
sold as one issue, then the remaining bonds, when subsequently sold, shall
be secured by the same character of lien and pledge as the first install—
ment, so that each and every bond of the whole authorization, when sold,
shall be of equal dignity and parity with each other bond herein issued.
All of said bonds shall be issued in accordance with and secured in the
manner provided in Articles 1111 to 1118, both inclusive, of the Revised
Civil Statutes of Texas, 1925, as amended.
SECTION 8.
That the City Secretary shall furnish election officials said bal—
lots, together with any other forms or blanks, in accordance with the
Charter of the City of Fort Worth, Texas, and the laws of the State of
Texas insofar as same are appli.cablee
SECTION 9.
This ordinance shall constitute the election order for such special
election, a substantial copy of which shall serve as the notice of elec-
tion under Article 704 of the Revised Civil Statutes of Texas.
SECTION 10.
The City Secretary is hereby authorized and directed to cause
notice of said election to be given by posting a substantial copy of the
election order in each of the election precincts of said City, and also
at the City Hall. The notice of said election shall also be published. on
the same day in each of two successive weeks in a newspaper of general
circulation published within said City, the date of the first publication
to be not less than fourteen (14) days prior to the date set for said elec—
tion, and the City Secretary shall see that proper publication is made and
proper notice of this election is given, in full conformity with the Charter
of the City of Fort Worth, Texas, and the general laws of the State of
Texas applicable thereto.
SECTION 11.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage, and it is so ordained,
