HomeMy WebLinkAboutOrdinance 9802f ORDINANCE NO. ~~---..2,/ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE PORTION OF 20TH STREET AS IT RUNS FROM THE EAST RIGHT-OF-WAY LINE OF NORTH GROVE STREET WESTWARD TO THE WEST RIGHT -OF-WAY LINE OF THE FORT WORTH BELT RAILWAY COMPANY PROPERTY, SAID PORTION OF 20TH STREET BEING LOCA'T'ED IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . THAT THE portion of 20th Street located in the City of Fort Worth, Tarrant County, Texas between the east right-of-way line of North Grove Street and the termination point of 20th Street in the west right-of-way line of the Fort Worth Belt Railway, he and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2 . That the fee to the land(s) in the above described vacated public street and right-of-way is hereby released and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and for any and all existing and prospective drainage requirements, as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. ~. SECT ION 4 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Ellis Addition, from 21st Street southward t o 20th Street ; the 2000 block of F1 ores Street from 21st Street southward t o 20th Street, and the 450 and 500 blocks of 20th Street from North Grove Street eastward to the east right-of-way line of the Fort Worth Belt Railway Company property, as recorded in Uol~me 63, Pages 19 and 20 and Volume 204-A, Page 146, P.R.T.C.T., as recommended by~°`the City Plan Commission. DISCUSSION James P1cCoy, agent for Petrochemicals Company, Inc., owner of abutting property, has requested that the City vacate the above-described alley and street rights-of-way, as shown on the attached map. The subject street and alley rights-of-way, acquired by dedication, are not open on the ground, but contain water, sewer and electric uti 1 ity faci 1 iti es . The subject vacation request is made in order to replat the vacated rights-of-way with adjoining property, to expand the building area, and provide more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. The City Plan Commission has reviewed this request and recommends that the subject rights-of-way be vacated as requested. Reviewing City departments and private utility companies have raised no objections t o this request, provided the vacated rights-of-way are replatted with adjacent property.
