AN ORDINANCE VACATING, ABANDONING, AND CLOSING ANb EXTIN- GUISHING A 10 FOOT EAST/WEST UTILITY EASEMENT LOCATED IN THE KIN ACRES ADDITION TO THE CITY OF` FORT WORTH, TARRANT COUNT Y, TEXAS; SAID EASEMENT BEING MORE SPECIFICALLY DESCRIBED THEREIN; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORD WORTH, TEXAS SECTION i. THAT THE 10 (ten) foot wide east/west utility easement located in the Kin Acres Addition to the City of Fort Worth, Tarrant County, Texas, as shown on the plat of said Kin Acres Addition recorded in Volume 388-5, Page 79, Plat Records, Tarrant County, Texas, said easement also being more specifically described in Exhibit nAee attached hereto and incorporated herein by reference for all pur- poses, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2 . T hat all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. APPROVED AS TO FORM AND LEGALITY: ~~ ity Attorney , Date: ADOPTS EFFECT EXHIBIT "A" BEING a tract of land situated in the Nancy Casteel Survey, Abstract #349, Tarrant County, Texas, and being a 10.0 foot wide Utility Easement located in a portion of Lots 2, 3, 4, 5, 8, 9, 10, and 11, Block 1, Kin Acres Addition to the City of Fort Worth as recorded in Volume 3885, page 79, Deed Records, Tarrant County, Texas, this portion of said 10.0 foot Utility Easement being further described by metes and bounds as follows: COMMENCING at a point being the northwest corner of Lot 1 of said Block 1, of Kin Acres Addition, said point also being the northeast corner of Lot 4, Block 1, Wildwood Acres Addition, to the City of Fort worth, as recorded in Volume 388-93, page 46, Deed Records, Tarrant County, Texas, said commencing point also being located in the south right-of-way line of Shady Lane, a public right-of-way; THENCE North 85° -12' East along said south right-of-way line, 175.2 feet to a point in the north boundary line of said Lot 2, said point being the most northerly northwest corner of the proposed Lot 2-R, Block 1, Kin Acres Addition; THEN CE South 04° -48' East with the west boundary line of said proposed Lot 2-R, 198.5 feet to a point in the north boundary line of said 10.0 foot wide Utility Easement, said point being the point of beginning of the herein described tract; THENCE North 87° line of said Lots feet northerly at distance of 201.6 being located in and being in the #2871 (Longvue Av - 36' East and parallel with the south boundary 2, 3, 4, and 5, Block 1, Kin Acres, and being 5.0 right angle from said south boundary line, a total feet to a point located in said Lot 5, said point the east boundary line of said proposed Lot 2-R, proposed west right-of-way line of F. (~,fs EI,`tD/1TE REFERENCE NUMBER sue~E VACATION OF A STREET RIGHT-OF-WAY PAGE :r real/13/87 ~ **PZ-1442 AND A UTILITY EASEP1ENT• KIN ACRES ADDI- i or l _ / ~„ f . - - ~ 7 ry~.fi~ RECOP1PIENDAT I ON ~s recommended that the City Council adopt an Ordinance vacating Eura Street (Block 2) from its intersection with Hwy. #2871 (Longvue Ave.) westerly t o its terminus (approximately 250' and a 10' wide (east/west) utility easement colinear with the rear property 1 i nes for Lots 3, 4, 9 and 10 and portions of Lots 2, 5, $, and 11, Block 1, Kin Acres Addition, all as recorded in Volume 388-5, Page 79, P.R.T.C.T., as recommended by the City Plan Commission. .DISCUSSION Thomas Head, on behalf of the Church of the Holy Apostles, Episcopal, has requested that the City vacate the above-described street right-of-way and utility easement, as shown on the attached map. The subject street right-of-way and utility easement, acquired by dedication, are unimproved and unused on the ground, and do not contain any utility facilities. The subject vacation request is made in order to replat the vacated right-of-way with adjacent property, t o expand the building area, and provide more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being replatted with adjacent property, and any required utility easements are retained.
