BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTS, TEXASs SECTION 1. That Dillard Avenue, from Sant Rosedale south 594.53 feet to a line 206 feet north of Calumet Street along Lot B, Block 30 and Lot B. Block 2R, Rosedale Plaza Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby close!, abandoned and permanently vacated an a street or public thoroughfare of any kind or character what- ever, save and except that easements are reserved for any and all existing utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3 . That all ordinances or parts of, ordinances in conflict herewith are hereby repealed. SECTION 4. BUCKMAN Mayor and Council Communication aRAHM DATE REFERENCE SUBJECT: Vacation of Dillard Avenue PAGE REED 6/30/69 NUMBER PZ-339 V-69-22 I or 1 The Ryan Mortgage Company, owner of all abutting property, and the City of Fort Worth Park and Recreation Department, the prospective purchaser, have requested the City to vacate Dillard Avenue from East Rosedale south 594.53 feet to a line 206 feet north of Calumet Street along Lot B, Block 3, and Lot B, Block 2R, Rosedale Plaza Addition as shown on the attached map. This request is made to permit acquisition and construction of an urgently needed playground site in this area. The Park and Recreation Department will not have sufficient area for the proposed playground unless Dillard-Avenue is vacated. Subject right-of-way, acquired by dedication, is not open on the ground. City Departments have reviewed street requirements and have determined that subject portion of Dillard Avenue is not needed for the following reasons: 1) Dunbar Junior High School, one (1) block west of Dillard Avenue would be better served by Liberty Street from Rosedale. 2) Developing this property as a playground rather than a shopping center eliminates the need for the street. 3) Construction of Andrew has provided access from Rosedale to this area, and opening Liberty Street will make it unnecessary to provide additional access. City Departments and private utility companies have reviewed this request and have no objections, provided the vacated right-of-way is retained as a utility easement. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested, subject to the condi- tion recommended above by the City Departments and private utility companies. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
