ORDINANCE ACCEPTING IMPROVE[+~iVTS ON A POR'T'ION OF SOUTH HAMPSHIRE
BOULEVARD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND
PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE
CONTRACT WITH AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID
IMPROVFY~'IENTS FULLY COMPI,ETID AND PERFORMID; DIRECTING THE
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND AIdAWED AGAINST SOME OF SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROL, THIS
ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF
THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE
COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID
CITY; AND PROVIDING AN EFFECTIVE DATE.
W'HEREA.S, the City of Fort Worth, Texas has heretofore entered into a
contract with State Department of Highways and Public Transportation, for the making
and construction of certain street improvements on the hereinafter described portions
of streets, avenues and public places in said City, to wit:
SOUTH HAMPSHIRE BOULEVARD From Tierney Road to Weiler Boulevard, known
and designated as Project No. 29-024307-00, a
six-inch thick hot-mix asphaltic concrete
pavement with seven-inch high concrete curb
and eighteen-inch wide `concrete gutter on an
eight-inch thick cement stabilized subgrade
so that the roadway will be thirty-feet wide.
Six-inch thick concrete drivectiay approaches
will be constructed where required.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 9693 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and
against the real and true owners thereof; and,
WE~,REAS, the City Council of the City of Fort Worth, Texas, has, upon
review, found and determined that, in some instances, in order to effect substantial
justice and equality, it is desirable and necessary to grant and issue certain credits
against some one or mare of the assessments levied by Ordinance No. 9693 and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract
therefore;
NOW, THEREFORE,
BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS,
THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully complete and
performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special asessments levied against
abutting property and the owners thereof for such improvements, and the City Secretary
is directed to attest same and impress thereon the corporate seal of the City, all in
accordance with the proceedings relating to such improvements and assessments. The
certificates shall be numbered, shall describe the property against which the
assessment has been levied, shall, where 3a~own, state the name or names of the true
owners of the respective parcels of property assessed and shall be issued in an amount
equal to the difference between the principal amount of the assessment and the amounts
of any credit issued thereon. The numbers of the certificates, with the property
descriptions to be shown on the respective certificates, together with the names of
the owners of said property, the principal amount of the assessment, the respective
credits, if any which are hereby authorized, granted and allowdd against the principal
amount of some one or more of the assessments heretofore levied, and the principal
amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabove
provided, same shall be delivered to the Tax Assessor-Collector as part payment of the
contract price.
VI.
The City Secretary is hereb;i directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth,
Texas, and by filing the complete ordinance in the appropriate Ordinance Records of
said City.
V.
This ordinance shall take effect and be
after the date of its passage.

DEVIATION~FROM BID PRICE
Final measured quantities at contract unit prices yield an earned total price
for this contract of $249,891.32 which is $4,745.92 (1.94%) over the bid price.
The overrun amount is the result of differences between quantities estimated for
the contract documents and quantities actually used to complete the work.
FINANCING
A bond fund transfer in the amount of $4,155.87 will be necessary from Street.
Improvements Fund 29, Project No. 024901-00 (in which sufficient. funds are
available) to Project No. 024307-00, Assessment Paving S. Hampshire Blvd. from
Tierney to Weiler. After this transfer, sufficient funds will be available in
Account No. 205015136, Retain age in the amount of $24,171.78; Encumbrance
Contract No: 15136A in the amount of $3,427.62, and Project No. 024307-00 in the
amount of $4,745.92 to finance this final payment.
COMPLIANCE WITH SPECIFICATIONS
