ORDINANCE N0.
AN ORDINANCE TRANSFERRING THE SUM OF $2,265,457.48 FROM
THE WATER AND SEWER FUND 45, UNAPPROPRIATED RETAINED EARN-
INGS, TO SEWER ADMINISTRATION, ACCOUNT N0. 70-10-00; PRO-
VIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That there is hereby appropriated the sum of $2,265,457.48 from
the Water and Sewer Fund 45, Unappropriated Retained Earnings, to
the 1986-1987 Sewer Administration, Account No. 70-10-00, for the
purpose of funding the buy-back arrangements contained in the whole-
sale wastewater contracts between the City of Fort Worth and nine
wholesale wastewater customers.
SECTION 2.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
" this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such un-
constitutional phrase, clause, sentence, paragraph or section.

SECTION 3.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas ( 1 986) , as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption in the
minutes of the City Council and by filing the ordinance in the ordi-
nance records of the City.
SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Recommendation
It is recommended that the City Council adopt the attached Supplemental
Appropriation Ordinance appropriating $2,265,458.00 from Water and Sewer
Operating Fund 45, Unappropriated Retained Earnings, to the 1986-87 Sewer
Administration Account No 70-10-00 to meet the new wholesale wastewater
contracts' special buy-back provisions.
Background

On April 7, 1987 (M&C,C-10266), the City Council authorized the City Manager to
execute a new uniform wholesale sewer contract with each of Fort Worth's 23
wholesale sewer customers. '
The City Council agreed to special modifications to the uniform contract in
order to recognize certain distinctions between the customers.
Fort Worth has negotiated and officially executed contracts with all but four
of these wholesale customers. Contracts for nine customer cities have been
modified to provide that Fort Worth "buy back" the respective contributions
made by the specified nine wholesale customer cities.
A schedule of the agreed upon "buy back" and the amount due to each city is
detailed below

A supplemental appropriation in the Water and Sewer Operating Fund 45, thereby
increasing appropriations in the 1986-87 Sewer Administration, Account No
70-10-00 and decreasing the unappropriated fund balance by $2,265,458 is

Contractual.
