AN ORDINANCE changing the grade of a certain portion of Magnolia Street in the City of Fort Worth, Texas, and providing for a subway under the tracks of the Missouri, Kansas & Texas- Railway Company of Texas. WHEREAS, the railway tracks of the Missouri, Kansas & Texas Railway Company of Texas now cross Magnolia Street at grade in the City of Fort Worth, Texas;and, WHEREAS, it is desired that the grade of a portion of Magnolia Street, as hereinafter d%scribed, be depressed and lowered so that said street will cross under the tracks of the said Missouri, Kansas & Texas Railway Company of Texas, as now constructed and operated; and, WHEREAS, it will be of public interest to have the travel along and upon said street pass under the tracks of the said Missouri, Kansas & Texas Railway Company of Texas by a subway rather than at grade; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COICTISSIONERS OF THE CITY OF FORT WORTH, TEXAS: SECTI0N I. That the present gr644 of Magnolia _ Street within the limits hereinafter named are hereby changed and established as follows: Beginning at a point 885 feet east of the east property or street line of South __-in Street, elevation 637.90; thence on a descending grade of 5.% for 205 feet to a point 1090 feet east of the east street line of South Hain Street, elevation 626.62; thence on a descending grade of 0.50,* for 300 feet to a. point 1390 feet east of the east street line of South Main Street, elevation 625. 12. SECTION 2: The said Missquri, K :. :sas & Texas Railway Company of Texas,by and through its Redeiver, hereby agrees that it will, at it and his own cost and-expense, do and perform all work and labor necessary to so change the grade of said street so as to have the same conform to the grade as established by this Ordinance. SECTION 3: The said Missouri, Kansas & Texas Rati-ay Company of Texas, acting by and through its Receiver, shall put the portion of said Magnolia Street , the grade of which is changed by this Ordinance, in as good condition for use and travel as the sane now exists on that } art of said street affected by the change of grade s- Att herein provided for. SECTION 4: Said issouri, Kansas & Texas Railway Company of Texas, acting by and through its Receiver, shall at its own expense, build and construct all of the understructure which shall be necessary to properly support the tracks of the said �-issouri, Kansas & Texas Railway Cor.pany of Texas, as the sarue shall pass oavr and above said Subway, and said subway when constructed and completed, shall have a width of 50 feet from the inside face of the south abutment to the inside face of the north abutment, and shall have two clear openings from a pier to be constructed in the middle of 23 feet 1-1/2 inches north and south of said middle ier, and said subway shall have a clearance of at least 14 feet between the grade of Magnolia Street and the superstructure of said subway. SECTION 5: The said Missouri, Kansas & Texas Railway Corpany of Texas, its successors, receivers or assigns, shall at its or their cost and expense, pave and repave, or othervise surface and resurface and keep constantly in good order and condition, all that portion of said Magnolia Street which extends over, utdeg or across the property and right of wuy of said Missouri, Kansas & Texas Railway Company of Texas. It being understood that the obligation to pave and repave said street shall not become effective until the other portions of said Magnolia Street connecting with the part extending over or under the property of the said railway company shall be paved. SECTION 6: This Ordinance shall-take effect and be in force from and after its passage. 1 I hereby certify that the above and fore going Ordinance was duly presented and unanimously passed and adopted by the Board of Commissioners of the CAty of Fort Worth, Texas, at a regular session of said Board held Tuesday May 28th, A.D. 1918.
