Home My WebLink AboutOrdinance 21998-12-2015 ORDINANCE NO.21998-12-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE INTERGOVERNMENTAL CONTRIBUTION FUND IN THE AMOUNT OF $120,000.00 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF REALIGNMENT OF THE LIVE OAK CONNECTOR PROJECT; PROVIDING FOR A SEVERABIL,ITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$120,000.00 from available funds, for the purpose of realignment of the Live Oak Connector project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the execution of an Interlocal Agreement with the Fort Worth Transportation Authority for the realignment of the Live Oak Connector Project; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$120,000.00. DISCUSSION: The Fort Worth Transportation Authority (The T) has developed plans for a Commuter Rail Project known as TEX Rail, to be constructed between the T&P Terminal Station in Fort Worth and Dallas/Fort Worth International Airport. The proposed alignment of the TEX Rail project and the City's Live Oak Connector Project are adjacent to each other at the intersection of Live Oak and E. 1 st Street. TEX Rail encountered a conflict with a franchise utility company near the stated intersection. The conflict resulted in the proposed alignment of the TEX Rail Project being shifted to the west approximately 20 feet. Consequently, the Live Oak Connector Project's proposed alignment at the intersection had to be adjusted as well. The Fort Worth Transportation Authority has agreed to enter into an Interlocal Agreement to reimburse the City for consultant fees, right-of-way and Staff cost associated with revising the proposed alignment of the Live Oak Connector Project. Under the Agreement, the Fort Worth Transportation Authority will reimburse the City an amount up to $120,000.00 which is the estimated costs.
