ORDINANCE N0. ~~" v~/ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE INTEREST OF THE CITY OF FORT WORTH IN THE PROPOSED EASEMENT DESCRIBED HEREIN, LOCATED IN LOT 1, BLOCK 306, AREA 3, SECTION 3, CENT REPORT ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECT ION 1 . That the thirty-six foot (36') wide proposed drill track ease- ment located in Lot 1, Block 306, Area 3, Section 3, of the Centreport Addition to the City of Fort Worth, Tarrant County, Texas, the plat of said Addition being recorded in Volume 388/17& at Page 79 and Volume 388/188 at Page 93, Plat Records of T arrant County, Texas, said proposed drill track easement being more specif- ically described in Exhibit "A" attached hereto and incorporated herein by reference for all purposes, be and the same is vacated, abandoned and permanently closed and extinguished. This ordinance shall only affect and is hereby specifically limited to the proposed drill track easement described herein; all other easements overlap- ping or contained within said proposed easement are excepted from this vacation, including but not necessarily limited to, that cer- tain 10' utility easement described in Volume 8212, at Page 172, of the Deed Records of Tarrant County, Texas. SECTION 2 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECT ION 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DISCUSSION Albert H. Halff Associates, Inc., on behalf of abutting property owners, has requested that the City vacate the above-described drill track easements, as shown on the attached map. The subject drill track easements, acquired by dedication, are platted but contain no utility facilities. The subject vacation request is made in order t o utilize the vacated easements as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property f)epartment, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objection t o this request. A satisfact ory replat has been submitted.
