ORDINANCE N0. ___1~~r AN ORDINANCE DEANNEXING AND DISCONTINUING TERRITORY FROM WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN DIRECT CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; AND PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That t-he hereinafter described territory within the corporate limits of the City of Fort Worth, Texas, be and the same is hereby deannexed and discontinued as part of the city of Fort Worth, Texas; said territory being described by metes and bounds as follows: BEING approximately 12.2 acres situated in the HAYS CONVINGTON SURVEY, Abst. No. 257 and the~C.A. KUYKENDALL SURVEY, Abst. No. 890, City of Fort Worth, Tarrant County, Texas, being a portion of that certain tract of land conveyed to Belgian American Investments and Trade,, Inc. by deed recorded in Volume 7658, Page 1588, Tarrant County Deed Records, also being a portion of a 100-foot wide strip of land annexed by the City of Fort Worth, December 23, 1968, by City Ordinance No. 6036, said 12.2 acres being more particularly described by metes and bounds as follows: BEGINNING at a point in the north line of said, Belgian American Investments and Trade, Inc. tract, and the south line of the Texas and Pacific Railroad, R.O.W., said point being S 59°20'51" W, approximately 510 feet from the south line of interstate Highway No. 20, said point also being N 59°20'51" E, approximately 1316.4 feet from the northeast corner of a tract of land conveyed to Texas Electric Service Co. by deed recorded in Volume 5419, Page 791, Tarrant County Deed Records; F THENCE N 59°20'51" E, along the north line of said Belgian American Investments and Trade, Inc. tract and the south line of said T&PRR R.O.W., approximately 350 feet to a point in the centerline of Walnut Creek; 0 . ~ ''i,• THENCE Southwesterly, along the centerline of said Walnut Creek approximately 5600 feet to a point in the west line of said Belgian American Investments and Trade, Inc. tract, said point being in the west line of said KUYKENDALL SURVEY and in the east line of the J.F. ELLIOTT SURVEY, Abst. No. 495; THENCE N 00°05'27" E, along the west line of said KUYKENDALL SURVEY and the east line of said ELLIOTT SURVEY, and along the west line of said Belgian American Investments and Trade, Inc. tract, approximately 85 feet to a 5/8'' iron in the south line of said Texas Electric Service Co. tract; THENCE N 61°32'40" E, along the north line of said Belgian American Investments and Trade, Inc. tract, and the south line of said TESCO tract, approximately 110 feet to a point; THENCE Northeasterly, parallel to and 100 feet west of the centerline of said Walnut Creek, approximately 5020 feet to the POINT OF BEGINNING and CONTAINING approximately 12.2 acres of land. SECTION 2. That the above-described territory is shown on the attached map marked Exhibit "A" on file in the office of the~City Secretary of the City of Fort Worth, Texas, which map is expressly incorporated herein by reference for the purpose of illustrating and depicting the location of the hereinabove described territory. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in direct conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall and the same is hereby made cumulative. SECTION 4. That it is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, ;~ ~ ' ~• sentence, or paragraph or section of this ordinance shall be *declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of such unconstitutional phrase, sentence, paragraph, or section. SECTION 5. That this ordinance shall be in full force and effect from and after the date of its publication and passage on second reading as provided for in Section 35 of Chapter XXVII of the City of Fort Worth, Texas, and it is so ordained.
