HomeMy WebLinkAboutOrdinance 9822e iF ' ORDINANCE N0. ~~-J AN ORDINANCE VACATING, .ABANDONING, AND CLOSING AND EXTIN- G UISHING THE 1200 BLOCK OF EAST WHITE STREET, ALSO KNOWN AS EVO STREET, AS FURTHER DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS a SECTION 1 . THAT THE portion of the 1200 Block of East White Street, also known as Evo Street, lying and being situated in the McConnell's Addition and the W. H. Bolte Addition (replat of Block H, Spencer's Subdivision) to the City of Fort Worth, Tarrant County,, Texas, described more specifically in Exhibit "A", attached hereto and incorporated herein by reference for all purposes, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2 . That the fee to the land(s) in the above described vacated portion of a public street and right-of-way is hereby released and shall revert to the adjacent owner (s ) as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements, as necessary. SECT ION 3. That all ordinances or parts of ordinances in conflict 'herewith are hereby repealed. ,, SECT ION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Moore Survey, Abstract No. 1093 and being a portion of the W.H. (V-86-33) ~ RECOMMENDATION t is recommended that the City Council adopt an Ordinance vacating the 1200 ~ ,~,/ lock of East White Street (A.K.A./Evo Street) from the west right-of-way line of Troost Street westerly a distance of approximately 907', located adjacent to and between Lot B, B1 ock 8, McConnel 1's Addition as recorded i n Vol ume 106, Page 72, P.R.T.C.T., and Lots 14 - 16, W. H. Bolte Addition (replat of Block "H", Spencer's Subdivision) as recorded in Volume 637, Page 428, D.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION Joe R. Felan, agent for Church's Fried Chicken, Inc., owner of abutting property, has requested that the City vacate the above-described street right-of-way, as shown on the attached map. The subject street right-of-way, acquired by dedication, is unimproved and contains no utility facilities. The subject request is made to permit replatting of the unimproved right-of-way with the adjacent property in order t o expand the building area and provide more useable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objection t o this request, subject to the vacated right-of-way being replatted with adjacent property. A satisfactory replat has been submitted.
