HomeMy WebLinkAboutOrdinance 1329 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORTORTH CLOSING A HEARING GIVEN TO PROPERTY OWNERS ON EL CAMPO AVENUE FROM HE LINE OF KOLEY STREET TO THE EAST LINE OF CLOVER LANE, AND SUSTAINING THE PROTESTS OF PROPERTY OWNERS ON THAT PORTION OF EL CAMPO AVENUE BETWEEN THE EAST LINE OF KENLEY STREET TO THE EAST LINE OF EMU STREET, AND ORMING THE OMIS- SION OF THE Ib0?ROVEMENTS ON SAID SECTION OF SAID STREET, AND CANCELLING THE CONTRACT AND BONDS FOR THE IMPROVEMENT OF SAID SECTION OF SAID STREET. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That, whereas, heretofore a resolution was duly passed by the City Council ordering the improvement of E1 Campo Avenue from the Fast line of Kenley Street to the East line of Clover Lane, in the City of Fort Worth, by raising, grading, excavating, paving, etc., and otherwise improvIing the same; and, WHEREAS, specifications were duly adopted, bids accepted after due advertisement, and contract entered into with Standard Paving Company for the construction of said improvements; and, WHEREAS, by a resolution duly passed, the City Council determined to levy an assessment against the abutting property and the owners thereof for their pro-rata of the cost of said improvements, in accordance with the charter of the City of Fort Worth; and, TIDtM", in accordance with said resolution and the charter of the City of Fort Worth, said property owners, their agents and representatives were notified by notices duly published in The Fort Worth Press, the official organ of the City of Fort Worth, and by registered letters con- taining a copy of said notice, to appear before the City Council at a hearing set by said City Council on the 11th day of October, 1927 at 9:30 V clock A. V., in the City Council Chamber, at the City Hall, in the City of Fort Worth, and there make protest or objection to said assess- ment or proceedings, Raid improvement or the cost of the same, or any other matter or thing concerning said improvement, assessment or proceed- ings that may appear to said property owners; and, WHEREAS, said hearing was duly had at said time and place, and at said hearing all property owners and their agents, attorneys or represent tines, and all interested persons who desire to file protests, remonstrances or objections, were given a full opportunity to file said protests, re- monstrances or objections, and were given a full and fair hearing on said protests, remonstrances and objections; and, W ZREAS, a majority of the property owners abutting on said El Campo Avenue from the Fast line of Kenley Street to the Fast line of Helen Street filed protests against the construction of said improvement on said E1 Campo Avenue from said East line of Kenley Street to East line of Hulen Street; and, whereas, the City Council is of the opinion that it will be for the best interest of said property owners and the City of Fort Worth at large to omit the construction of improvements on said section of El Campo Avenue from the East line of Kenley Street to the East line of Helen Streets Row, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That the protests filed by the owners of property between the East line of Kenley Street and the East line of Hulen Street, be and the same are hereby sustained, and the improvement heretofore ordered constructed on said por- tion of E1 Campo Avenue between the East line of Kenley Street and the East line of Hulen Street, be and the same is hereby ordered omitted, and the contract and bonds between the City of Fort Worth and Standard Paving Company, so far as the same relate to El Campo Avenue from the East line of Kenley Street to the East line of Hulen Street, be and the same are hereby cancelled and for naught held; and, WMIZAS, all errors and mistakes that were called to the attention of the City Council were rectified and corrected; and, whereas, the City Council is of the opinion that all said protests, remonstrances and objec- tion except those hereinabove specified, so filed and heard, are without merit and should be overruled; and, WIDMRAS, the City Council, after duly considering the benefits that each property owner and its, his or her property receives from the malting of said improvements, is of the opinion that said assessments heretofore determined to be levied are fair and equitable and represent the benefits that said property will receive in enhanced value from the making of said improvements, and said assessments should be made as heretofore determined, with the exception of those upon that section of said street lying between the But line of Kenley Street and the East line of Bolen Street$ Now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That all protests, remonstrances and objections filed at said hearing except those hereinabove specifically sustained be and the same are hereby overrule& and that said hearing be and the same is hereby declared finally closed. That this ordinance shall take effedt and be in force from and after its passage. PASSED AND APPROVED, this 11th day of October, 1927. Mayor. Attests City Secretary.
