HomeMy WebLinkAboutOrdinance 9930.r ~ y '~~ ORDINANCE N0. ~~~d~/ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING PORTIONS OF STREET RIGHT-OF-WAY AND ALLEY RIGHT- OF-WAY IN THE PROSPECT HEIGHTS ADDITION AND FRISCO HEIGHTS ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR REVER- SION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE portion of Hagler Avenue, the portion of Forest Park Boulevard and the north/south alley described more specifically in Exhibit "A", attached hereto and incorporated herein by reference for all purposes, be and the same are vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land(s) in the above described vacated portions of the respective public streets and public alley are hereby released and shall revert to the adjacent owner(s) as pro- vided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements, as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. t . r ,- SECTION 4. APPROVED AS TO FORM AND LEGALITY: / ® _ , ~~e~, ity Attorne Date: ADOPTED: EFFECTIVE: -2- ,~ F~iIBIT 'A" r ~^4 s ,~ FIELD MOTES FOR VACATION OF STREETS AND AN ALLEY ADJACENT TO BLOCK 4, PROSPECT HEIGHTS AND BLOCK 16, FRISCO HEIGHTS FORT WORTH, TARRANT COUNTY, TEXAS BEING a part of the alley and that part of Forest Park Boulevard adjacent to Block 4, Prospect Heights and also a part of Hagler Avenue north of said Block 4; and said vacated right-of-way being more particularly described as follows: BEGINNING at the southwest corner of Lot 2, Block 4, Prospect Heights Addi- tion as shown by plat recorded in Volume 63, Pages 59 and 60 of the Deed Records of Tarrant County, Texas, said point also being in the east line of the alley and the north line of West Lowden Street; THENCE N 89° 49' W, with the north line of West Lowden Street, 16.0 feet to a point on the west line of said alley; ` THENCE N 0° 11' E, 83.3 feet to a point on the north line of Hagler Street; THENCE due east with the north line of Hagler Street, 192.4 feet to a point the proposed west Iine of Forest Park Boulevard, said point also also being on a curve from which the center of said curve bears N 75° 20° W, 197.49 feet; THENCE southerly with said curve to a central angle of 5° 26' for a distance of 18.7 feet to the end of said curve; THENCE continuing S 20° 06' W, with said proposed west line of Forest Park Boulevard, 70.2 feet to a point in the north line of West Lowden Street, extended easterly; THENCE N 89° 49' W, 21.9 feet to a point at the original southeast corner of said Lot 2, Block 4, Prospect Heights Addition; THENCE N 0° 11° E, with the east line of said Lot 2 at 50 feet pass the northeast corner of said Lot 2, in all 60.0 feet to a point in the south line of Hagler Avenue; THENCE N 89° 49' W with the south line of Hagler Avenue, 125.0 feet to a point in the east line of said alley; THENCE S 0° 11' W, with the east line of said alley at 10.0 feet pass the northwest corner of said Lot 2, in all 60.0 feet to the place of beginning and containing 7,382 square feet of land, of which 4,456 square feet is in Hagler Avenue, 1,966 square feet within the right-of-way of Forest Park Boulevard and 960 square feet within the boundary line of said alley. HEIGHTS ADDITION, BLOCK 4, LOT 2 ' °r-.__ FRISCO HEIGHTS ADDI N, , HAGLER AVENUE AND FOREST PARK BOULEVARD Recommendations It is recommended that the City Council adopt an Ordinance vacating a portion of Hagler Avenue (21' wide right-of-way) from Forest Park Boulevard, westerly 180' to a 16' wide north/south alley, containing approximately 4,456 square feet; a triangular-shaped portion of Forest Park Boulevard located adjacent to the east property line of Lot 2, Block 4, Prospect Heights Addition, containing about 1,966 square feet; and a 16' wide north/south alley from West Lowden Street north to Hagler Avenue 1-ocated adjacent to the west property line of Lot 2, Block 4, Prospect Heights Addition, as recorded in Volume 63, Page 59 and 60, P. R. T.C.T., containing approximately 960 square feet, as recommended by the City Plan Commission. Discussion Suzanne Haynes, owner of abutting property, has requested that the City vacate the above-described street and alley rights-of-way, as shown on the attached map. The subject street and alley rights-of way, acquired by dedication, are open on the ground, and contain sewer. and .electric utility facilities. The subject vacation request is made in order to rep at the vacated- rights-of-way with adjoining property, to expand the building area, and provide more usable yard space. The required monetary consideration, in the amount of $100.00, has been placed in escrow with the Real Property Department, as determined by the Director of ,,~. Real Property Management for the City of Fort Worth. The City Plan Commission has reviewed this request and recommends that the subject rights-of-way be vacated as requested. Reviewing City departments and private utility companies have raised no objections to this request, provided the vacated rights-of-way are replatted with adjacent property `and any necessary utility easements are provided. A satisfactory replat has been submitted.
