HomeMy WebLinkAboutOrdinance 17944-01-2008Ordinance No. 17944-01-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,11,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE VAQUERO SCULPTURE PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the, Specially Funded Capital Projects Fund in the amount of $111,000 from available funds for the purpose funding the Vaquero Sculpture Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. No. 17944-01-2008 DATE: Tuesday, January 08, 2008 LOG NAME: 03VAQUERODONATE REFERENCE NO.: G-16014 SUBJECT: Approve Acceptance of Donations to the Vaquero Sculpture Project and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Accept donations to the Vaquero Sculpture project totaling $111,000; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $111,000 in the Specially Funded Capital Projects Fund. DISCUSSION: A group of citizens, known as the Vaquero Committee, have successfully raised $111,000 in private funds to match $95,000, which City Council appropriated to the Specially Funded Capital Projects Fund on November 11, 2003, (M&C C-19846) .for the Vaquero Sculpture project. Acceptance of these donations will enable the Fort Worth Public Art program to commission local artist David Newton to fabricate and install a bronze equestrian sculpture depicting a Mexican Vaquero for the traffic island located at North Main and Ellis Streets. The purpose of this project is to honor the important role the Vaquero played in making Fort Worth, a hub of the cattle industry in the late 19th Century. The Vaquero Sculpture will serve as a landmark for the Historic Marine Urban Village. BACKGROUND: On January 20, 2004, (M&C C-19935) City Council authorized an artwork design contract with artist David Newton in an amount not to exceed $25,000. Under the design contract, David Newton finalized the design of the sculpture to ensure the historical accuracy of the sculpture by working closely with the Vaquero Committee and produced moquettes (small scale models) of the sculpture. In addition, the Artist worked with the project consultants, Kimley-Horn & Associates, on the design of the site and base for the sculpture, including engineering, paving, lighting, landscaping, seating, and pedestals to receive bronze plaques to contain educational information about the Vaquero's importance in Fort Worth history, as well as donor recognition. The site and base for the Vaquero Sculpture were completed as part of the North Main Streetscape Improvement Project. Since 2004, the Vaquero Committee have been in the process of raising the $95,000 in matching funds; however, during that time period fabrication and labor costs for the sculpture have increased by approximately 10 percent. As a result, the total cost of the sculpture is $206,000. The Vaquero Committee has successfully raised $111,000 in private funds, which includes the cost increase. This project is located in COUNCIL DISTRICT 2, but serves the entire City.
