HomeMy WebLinkAboutOrdinance 9832 ORDINANCE N0. l~~L AN ORDINANCE AMENDING THE BUILDING CODE OF THE CITY OF FORT WORTH, CODIFIED AS CHAPTER 7, ARTICLE III OF THE CODE OF THE CITY OF FORT WORTH ( 19°d6) , AS AMENDED, BY ADOPTING APPENDIX CHAPTER 1 1 , "AGRICULTURAL BUILDINGS°' OF THE 1982 EDITION OF THE UNIFORM BUILDING CODE WITH CERTAIN AMEND- MENTS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That Section 7-46 of the Code of the City of Fort Worth (1986), as amended, is hereby amended by revising Paragraph (b) thereof to read as follows: (b) The following provisions of the Appendix to the 1982 Edition of the Uniform Building Code, as amended hereby, are hereby specifically adopted as a part of the Building Code of the City: Chapter 1, Life Safety Requirements for Existing Buildings; Chapter 2, Existing High-Rise Build- ings (which is added to such Appendix by section 7-47 of this article); Chapter 7, Covered Mall Buildings; Chapter 11, Agricultural Buildings; Chapter 32, Re- roofing; Chapter 38, Basement Pipe Inlets; Chapter 49, Patio Covers; Chapter 55, Membrane Structures; Chapter 56, Piers and Boathouses (which is added to such Appendix by section 7-47 of this article); and Chapter 70, Excavation and Grading. SECT ION 2 . That Appendix Chapter 11, Agricultural Buildings, of the 1982 Edition of the Uniform Building Code is hereby amended by revising the title and Section 1107 and by adding Section 1112 to read as follows: .,, ., "Chapter 11 Agricultural Buildings and Detached Shade Structures for Group B Occupancies" Scope Sec. 1107. The provisions of this chapter shall apply exclusively to: a) Agricultural buildings Such buildings shall be classified as a Group M, Division 3 Occupancy and shall include the following uses: 1. Storage, livestock and poultry. 2. Milking barns. 3. Shade structures. 4. Horticultural structures (greenhouse and crop protection); and b) Shade structures for Group B occupancies. ~ ~r Detached Sunshade Structures Sec. 1112. Detached sunshade structures for Group B Occupancies shall not be enclosed and shall be of noncom- bustible construction. SECT ION 3 . It is hereby declared to be the intention of the City Council ` that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City -2- -~ Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas ( 1964.) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECT ION 5 . It shall be unlawful for any person to erect, construct, en- large, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure in the City or cause the same to be done contrary to or in violation of any of the provisions of this Code. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resist the enforcement of any of the provisions of this Code with respect to fire safety shall be fined not more than One Thousand Dollars ($1,000.00) for each offense and with respect to all other provisions of this Code shall be fined not more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6 . All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of -3- 1 ,:~ '~ Ordinance No. 9280 or any other ordinances affecting construction and fire safety which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be•prosecuted until final disposition by the courts . Building permits heretofore issued under existing ordinances shall be valid for the time being for which they were issued under the existing building code but upon expiration thereof the same shall be void. SECTION 7 The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish the caption and Sections 1, 2, 5, 9, and 10 in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECT ION 8 . The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1, 2, 5, 9 and 10 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -4- ., .n °;,. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and Sections 1, 2, 5, 9 and 10 of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Art. 1176b-1, Revised Civil Statutes of Texas. SECTION 10 . This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. G -6967 i or- RECOMPIENDATION It is recommended that the City Council adopt the attached ordinance amending the Building Code of the City of Fort Worth by adopting Appendix Chapter 11 of the 1982 Uniform Building Code, with minor amendments. DISCUSSION _ On February 12, 1987, the Construction and Fire Prevention Board of Appeals recommended adoption of a proposed amendment to the Building Code that would adopt Appendix Chapter 1 1 of the 1982 Uniform Building Code, with minor amendments. This Chapter relates to agriculture purposes such as growing of vegetables and other farm products in enclosed structures during the colder months. The amendment will also permit sunshade structures for B-2 Occupancies, such as non-combustible covers for flea markets (provided there are no enclosures), carports and si milar structures t o be built.
