HomeMy WebLinkAboutOrdinance 9833 ~ „~ ORDINANCE NO. ~~~± AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING A PORTION OF A UTILITY EASEMENT LOCATED IN THE OVERTON SOUTH ADDITION OF THE CITY OF FORT WORTH AS FURTHER DESCRIBED HEREIN, REPEALING ALL ORDINANCES. IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTTVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. THAT THE portion of a 10` wide utility easement located in the Overton South Addition to the City of Fort Worth, Texas, described more specifically in Exhibit "A" attached hereto and incorporateck herein by reference for all purposes, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION Sam Kartalas, on behalf of Dunning Development Company, owner of abutting property, has requested that the city vacate a 1,5' wide by 10' strip of the above-described easement, as shown on the attached map. This portion of the subject easement, acquired by dedication, is platted and does not contain any public utilities. Vacation of the easement portion is appropriate to eliminate encroachment by an existing structure. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort 4dorth. Reviewing City departments and private utility companies have raised no objections to this request.
