AN ORDINANCE AMENDING CHAPTER 22, ARTICLE VII, DIVISION 2,
"REGISTRATION", OF THE CODE OF THE CITY OF FORT WORTH,
TEXAS (1986), AS AMENDED, TO PROVIDE THAT, IN ADDITION TO
THE FIRE DEPARTMENT, THE DESIGNEE OF THE CHIEF OF POLICE
SHALL HAVE THE AUTHORITY AND DUTY TO REGISTER BICYCLES AND
PROVIDE APPROPRIATELY DESIGNATED REGISTRATION NUA9BERS FOR
SUCH BICYCLES; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
PUBLICATION; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS :
SECTION 1.
That Chapter 22, Article VII, Division 2, "Registration", of
the Code of the City of Fort Worth, Texas (1986), as amended, is
hereby amended to read as follows:
"Sec. 22-261. Required
It shall be unlawful for any person to operate or use
a bicycle propelled wholly or in part by muscular power
upon any of the streets, alleys or public highways of the
City without first obtaining from the Fire Department, or
designee of the Chief of Police, a registration number
therefor as provided in this division.
°'Sec. 22-262. Duration; effect of registration
The Fire Department, or designee of the Chief of
Police, is hereby authorized and directed to register
bicycles, which registration shall be effective for the
life of the bicycle, and all such registration numbers,
when issued, shall entitle the registrant to operate such
bicycles for which such registration numbers have been
issued upon all the streets, alleys and public highways,
exclusive of the sidewalks thereof, in the City.

"Sec. 22-263. Procedure
The Fire Department shall provide at all reasonable
hours a registration number stamped thereon, commencing
with the number "1", with each number prefixed with the
number of the fire station from which such bicycle is
registered. The designee of the Chief of Police shall, at
the Chief of Police's direction, provide a registration
number stamped thereon, commencing with the number "1",
with each number prefixed with the letters FWPD. It shall
be the duty of the Fire Department, or designee of the
Chief of Police, to stamp the frame of each bicycle upon
the payment of a registration fee, herein provided, and
such shall at all times during the life of the bicycle
remain with no obliteration. At the time of the issuance
of the registration number, the Fire Department, or desig-
nee of the Chief of Police, shall forward to the Police
Department, Youth Section, the record of the date of the
issuance of each registration, the name of the person to
whom the same is issued and the number thereof.
"Sec. 22-264. Seizure of unregistered bicycles
Any bicycle found upon any street or other public
place of the City without a registration as required by
this article shall be seized by any police officer and
held by the Police Department until such registration has
been granted.
"Sec. 22-265. Removal, destruction or alteration of num-
ber, etc.
It shall be unlawful for any person to willfully or
maliciously remove, destroy, mutilate or alter the number
of any bicycle frame registered pursuant to this article.
It shall also be unlawful for any person to remove, de-
stroy, mutilate or alter the number of any registration
number, or registration card for identification purposes.
"Sec. 22-266. Fee
The registration fee to be paid for each bicycle
shall be one dollar ($1.00) and shall be paid in advance;
and pursuant to Section 22-241 of this article, such
registration number may be transferred when the ownership
of such bicycle is transferred, and a fee of twenty-five
cents shall be paid for such transfer. All registration
fees collected under this article shall be paid into the
general fund of the City."

SECTION 2.
This ordinance shall be cumulative of all provisions o.f ordi-
nances and of the Code of the City of Fort Worth, Texas (1986), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
Any person, firm or corporation who violates, disobeys, omits,
neglects or refuses to comply with or who resists the enforcement of
any of the provisions of this ordinance shall be fined not more than
Two Hundred Dollars ($200.00) for each offense. Each day that a vio-
lation is permitted to exist shall constitute a separate offense.

SECTION 5.
All rights and remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of the provisions of
Ordinance No. 6550 or any other ordinances affecting bicycles which
have accrued at the time of the effective date of this ordinance;
and, as to such accrued violations and all pending litigation, both
civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts..
SECTION 6.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
Sections 1, 4, 7 and 8 in the minutes of the City Council and by
filing the ordinance in the ordinance records of the City.
SECTION 7.
The City Secretary of the City of Fort Worth, Texas, is hereby
directed to publish the caption and Sections 1, 4, 7 and 8 of this
ordinance for two (2) days in the official newspaper of the City of
Fort Worth, Texas, as authorized by Art. 1176b-1, Revised Civil
Statutes of Texas.

SECTION 8.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance amending the
City Code to permit the designee of the Chief of Police to register bicycles in
the same manner as the Fire Department.
DISCUSSION
Chapter 22, Article VII, Division 2, "Registration", of the Code of the City of
Fort Worth requires any person who operates or uses a bicycle upon any street,
alley or public highway t o register said bicycle with the Fire Department prior
to the operation or use of the bicycle. Currently, a bicycle may only be
registered at fire stations..
If the ordinance i s amended to allow the designee of the Chief of Police t o
register bicycles, there would be an increase in service to the citizens, but
there would not be an increase in cost.
