HomeMy WebLinkAboutOrdinance 1729 ORDINANCE N0, 1729 AN ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL DIRECT AD VALOREM TAX ON ALL PROPERTY REAL, PERSONAL .AND MIXED SITUATED WITHIN THE TERRI- TORIAL LIMITS OF THE CITY OF FORT WORTS, AND ALL PERSONAL PROPERTY OWNED IN SAID CITY OF FORT WORTH, MU&S, ON THE FIRST DAY OF JANUARY, A. D. 19319 XX- CWT SUCH PROPERTY AS MAY HS EXR&:'P FROM TAUTION BY TER CONSTITUTION AND LAWS OF THE STATE OF TEXAS. BE IT ORDAINED BY TEL? CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I• There is hereby levied and shall be collected, as provided by law, an annual,direct,special ad valorem tax for the year 1931 for the support and maintenance of a free Public Library in the City of Fort Horth of three cents (3#) on every $100900 valuation on all property real, per- sonal and mixed situated in and all personal property owned in the City of Fort Worth on the first day of Xanuary, A• D. 1931, liable under the law to taxation and not exempt therefrom by the Constitution and Laws of the State of Texas. SECTION II9 There is also hereby levied and there shall be collected, as provided by law, an anmml,direot,special ad valorem tax for the year 1931, for the use and benefit of the Park Fund of the City of Fort Worth of nine cents (9¢) on every $100.00 valuation on all property real, per- sonal and mixed situated in and all personal: property owned in the City of Fort Worth, Tem, on the first day of Xanuery, A. D. 1931, liabift under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas, which levy, in the aggregate sum of nine cents (9g) as aforesaid, shall be and in hereby apportioned: For park operation, maintenance and upkeep .083905 cents; For the benefit of notes issued to F. 8. Daggett for the purchase of certain lands for park purposes as recited in Or- dinance Nog 903 ,001955 cents. The original amount of this series of notes was $34,248.00 and of which there is now out- standing and unpaid $6,849960; For the benefit of notes issued to the West Texas Construc- tion Company for the improvement of forest Park as recited in Ordinance Nos. 1036 and 105€9 .002920 cents. The original amount of these notes was $52,000.00 and of which there is now outstanding and unpaid $25,000.00; and For the benefit of notes issued to Freehold Property Cam- pany for purchase of certain bonds for Pert Purposes .001220 cents. The original amount of these notes was $10,830.00 anb of which there is now outstanding $29166.00. MOTION III. There is alae hereby levied and there shell be collected, as provided by law, an annual, direct, special ad valorem tax for the year 1931, for the use and benefit of the Recreation Fund of the City of Fort Worth, of two cents (8f) on evert $100.00 valuation: on all property real, personal and mixed situated in and all personal property owned in the City of Fort Worth, Texas, on the first day of January, i. D. 1931, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas, whish levy, in the aggregate sum of two cents (8¢) as aforesaid, shall be and is hereby apportioned: For Recreation operation, maintenance and upkeep •014522 cents; For the use and benefit of certain improvement notes, dated Dec- ember 179 1921, issued to Jay F. Wills, as set out in Ordinance No. 801, for the construction and building of a concrete swimming pool in Forest Park, .401915 cents. The original amount of this series of notes was $35,000.00 and of which there is now outstanding and unpaid $3,500.00; For the use and benefit of Recreation Funding Warrants, dated May 159 1923, as recited in Ordinance No. 923, •003017 cents. The original amount of which was $59,900.00, of which amount $28,000.00 of this series of notes are outstanding and unpaid; and also $7,000.- 00 worth of Recreation notes, as recited in Ordinance No. 976, of which $1,000,00 are now outstanding and unpaid, .000546 cents. That there is also hereby Levied and there shall be collected, as provided by law, an amental, direct, special ad valorem tax for the year 1931, for the interest and sinking fund upon the existing bonded indebted- ness of the said City of Fort Worth, of .593652 cents on every $100.00 valuation on all property real, personal and mixed situated in and all personal property owned in the City of Fort Worth on the first day of Janmwy, 1. Tont there is also hereby levied and there shall be e01- looted, as provided by law, an annual, direct, special ad valorem tax for the year 19319 for general and all such other purposes (besides those hereinbefore enumerated), as are authorized by law and by the Charter of said City of Fort Worth, of 9956348 cents on every $100.00 valuation on all property reel, personal and mixed situated in sad all personal prop- erty owned in said City of Fort Worth on the first day of January, A. D. 1931s liable under the law to taxation sad not exempt therefrom by the Constitution or laws of the State of Texas. SEM ON vI• That these special tax leries, which are hereinbefore rade, to provide for the payment of interest and to create a sinking fund or to discharge and pay principal and interest on any obligations due or owing by the City of Fort Forth, are not to be taken as in addition to levies for the same purpose made in the respective ordinances authoriz- ing and creating such obligations, bat the levies hereinbefore made are made pursuant to and for the purpose of carrying out and complying with the prorisions of said prior ordimuces, and ad valorem taxes herein are levied upon all taxable property real, personal and mixed situated in and all personal property owned in the City of Fart Worth, Texas, as assessed, valued and described is the assessment tax rolls and the tax books of the City of Fort Worth, for the year 19319 and any supplemental assessments thereof, as the same have been or shall be presented to the City Council of the City of Fort Worth by the Assessor and Collector of Taxes of said City of Fort worth. SZOTION YII+ That the taxes herein levied and authorized and required to be collected shall be and become due and payable in two equal installments. The first installment, which amount shall be fifty per cent of the total sum of the taxes due and payable for the current year, shall be due and payable on the first day of October, A. D. 1931, and the second install- went, which amount shall be the reeamining fifty per cent of the total am due and payable in taxes for the current year, shall become due and payable on the first day of April$ A. D. 1932. SECTION VIII. The first installment of taxes required to be paid by vir- tue of this ordinance for the current Tear shall become delinquent on the first day of December, A. D. 19319 and the second installment of taxes required to be paid by virtue of this ordinance for the current year shall beaomee delinquent on the first day of Tune, A. D. 1932. SECTION IX* Should any taxpayer permit his tames to become delinquent, that is to may, should fail or refuse to pay the first installment, said installment being fifty per cent of the total amount of taxes due for the current year, before the first day of December, A. D. 1531, as above spec- ified, thea and in that event, the second installment shall also immediate- ly become due and delinquent and a penalty shall attach to the payment of such taxes at the rate of one per cent per month, or fraction thereof, for each month thereafter; and should any taxpayer pay the first installment of his taxes as hereinabove provided, but should permit the second install- ment of his taxes to becomes delinquent, that is to say, should fail or re- fuse to pay said second installment before the first day of Tune, A. D. 1932, as above specified, then the penwlty shall attach to the payment of the second installment at the rate of one per cent per month, or fraction thereof, on each month thereafter. SECTION Z. That said penalty of one per cent per month shall be added to said taxes in the event the payment thereof abould become delinquent as above set forth and said penalty shall attach on the first day of each month thereafter until the taxes shall have been paid, which penalty shall be and beoome a part of said taxes and be payable as such, and provided further that in the event of the publication of the delinquent tax lists, or if snit is brought to recover such taxes and penalties and the delinquent taxpayer shall be subject to the payment of said taxes, penalties and costs„ and the same shall be and become a lion upon the prop- erty of such taxpayers, as prescribed by the Charter of the City of Fort 'forth and the laws of the State of Texas, the said taxes with penalties and costs skull be and become and they are hereby made a paramount lien to all other liens whatsoever on the property on which said taxes are levied. S=ION II. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sec- tions or parts of sections of this ordinance, which provisions shall be, remain and oontinae to be in full force and effect.
