AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A UTILITY EASEMENT IN THE CARL GIBBON SUBDIVISION OF THE CITY OF FORT WORTH, TEXAS, DESCRIBED MORE SPECIFI- CALLY HEREIN; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 4 foot wide utility easement, described more specifi- tally in Exhibit "A" attached hereto and incorporated herein for all purposes, lying within the Carl Gipson Subdivision of the City of Fort Worth, Texas, the plat of said subdivision being recorded in Volume 1949, Page 295 of the Deed Records of Tarrant County, Texas, to which reference is hereby made, be and the same is vacated, abandoned and permanantly closed and extinguished. SECT ION 2 . T hat all ordinances or parts of ordinances in conflict herewith are hereby repealed. 5 E CT I ON 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. R. T. C. T. DISCUSSION Charles Edmonds, Jr., Chairman of the American Red Cross, owner of abutting property, has requested that the City vacate the above-described easement, as shoran on the attached map. The subject easement, acquired by dedication, is platted but contains no utility failities. The subject vacation request is made in order to utilize the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escraa with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility ccenpanies have raised no objections to this request. A satisfactory replat has been submitted. DAI/sfggq APPRQVED BY CITY COUNCIL.
