HomeMy WebLinkAboutOrdinance 9843~t e ~ q ORDINANCE NO. ~i~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING CERTAIN STREET RIGHTS-OF-WAY AND PUBLIC OPEN SPACE EASEMENTS LOCATED IN THE ALTA MERE ADDITION TO THE CITY OF FORT WORTH, AS FURTHER DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH , TEXAS: SECT' ION 1 . THAT , 1) the portion of Ashville Avenue between the east right-of-way line of Marquita Drive and the west right-of-way line of State Highway #183 (Alta Mere Drive) adjacent to the 7200 and 7300 Blocks of Ashville Avenue in the Alta Mere Addition to the City of Fort Worth, Texas, as shown on the plat thereof recorded in Volume 388-203, Pages 94 and 94A, Plat Records of Tarrant County, Texas; 2) the portion of Joyce Drive between the north right- of-way line of Ashville Avenue and the south right- of-way line of Calmont Avenue, adjacent to the 2800 Block of Joyce Drive in the Alta Mere Addition to the City of Fort Worth, Texas, as shown on the plat thereof recorded in Volume 388-58, Page 654, Plat Records of Tarrant County, Texas; 3) the three (3), 20' x 20' open space easements located in the northwest, southwest, and southeast corners, respectively, of Lot 1-A, Block 4, in the Alta Mere Addition to the City of Fort Worth, Texas, as shown on the plat thereof recorded in Volume 388-58, Page 654, Plat Records of Tarrant County, Texas; 4) the two (2) 20' x 20' public open space easements located in the northeast corner of Lot 1-R1, Block 7 and the northwest corner of Lot 1-R, Block 8, respec- tively, of the Alta Mere Addition to the City of Fort Worth, Texas, as shown on the plat thereof recorded in Volume 388-203, Pages 94 and 94A, Plat Records of Tarrant County, Texas; and, ~ ~ :q~ ,. ,~ 5) the 20' x 20' open space easement located at the Southwest corner of Lot 1-R, Block 3, in the Alta Mere Addition to the City of Fort Worth, Texas, as shown on the plat thereof recorded in Volume 388-104, Page 188, Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned, and permanently closed and extinguished. SECT ION 2 . That the fee to the land(s) in the above described vacated street rights-of-way and public utility easements are hereby re- leased and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements in the vacated street rights-of-way described in Section 1, Paragraphs 1 and 2 above, are hereby re- tained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements, as neces- sary. SECT ION 3 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. sEC~r ION 4 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DISCUSSION David Ryan, owner of abutting property, has requested that the City vacate the above-described streets and public open space easements, as shown on the attached maps. The subject street rights-of-way and public open space easements., acquired by dedication, are unimproved and unused on the ground, and do not contain any utility facilities. Reviewing Gity departments and private utility companies have raised no objections t o this request, subject; to the vacated rights-of-way being replatted with adjacent property, and any required utility easements are retained. A satisfactory replat has been submitted.
