AN ORDINANCE TRANSFERRING THE SUM OF $16,000 FROM THE UNDESIGNATED FUND BALANCE OF THE GENERAL FUND AND APPRO- PRIATING THIS AMOUNT TO ACCOUNT NUMBER 90-96-00, NON- DEPARTMENTAL, MINORITY BUSINESS ENTERPRISE OFFICE; PROVID- ING FOR A 5EVERABILITY CLAUSE; .MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That there is hereby transferred $16,000 from the Undesignated Fund of the City of Fort Worth to Account No. 90-96-00, Non- Departmental, Minority Business Enterprise Office, for the purpose of funding a temporary staff position in the Minority Business Enterprise office. SECT ION 2 . It is hereby declared to bE~ the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. ~~' ` SECTION 3 . This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECT ION 4 . The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Section 1 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECT ION 5 . This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. Authorize the City Planager to execute a one year contract with Fort Worth Independent School District, for the City to perform services necessary t o certify Minority Business Enterprises (P16E) and Women-owned Business Enterprises (WBE) for the District. 2. Adopt a supplemental appropriations ordinance appropriating $16,000 from increased estimated receipts of the General Fund to Non-Departmental, Account No. 90-96-00 for the purpose of hiring temporary staff in the MBE Office to provide the services in this contract. DISCUSSION In December 1986, the Fort Worth Independent School District (District) requested a meeting with the City's MBE office staff to discuss the possibliity of the city acting as the sole certifying entity f or MBEs and WBEs desiring to participate on bids/proposals issued by the District during its current bond program. After lengthy discussions, it was agreed by both parties that the City would need t o hire a person to provide the certification services requested by the District and that the District would reimburse the City one hundred percent (100%) of the cost for this individual including salary, fringe benefits as required and out-of-pocket expenses. This individual will provide certification services t o District referrals only, on an "as needed" basis, and will be terminated at the- conclusion of the contract between the City and the Distri ct. The f ollowing services will be provided by the City: 1. Preparation of and furnishing certification forms. 2. As necessary, consult and interview MBEs and WBEs t o assist in the certification process. 3. Review and verify applications and documentation for certification of MBEs and WBEs, including necessary site visitation. When possible, City will attempt to complete the certification process within 3-5 working days. As used herein, the term working day shall mean any week day on which the offices of the City are open for business. 4. Notify District of approval and disapproval of all applicants f or certification or suspension of cerification, including any filing of an appeal. Recertify on a 12 month anniversary basis the MBEs and WBEs who have been certified by the City-. 6. Conduct meetings between a representative of the District and the City's MBE/WBE Coordinator and review and evaluate the certification procedure. The City wi 11 hire a temporary employee to service this contract. The Distri ct anticipates that the volume of participants will require less than a full time person. The total fee to be paid by the District to the City shall not exceed $16,000, including out-of-pocket expenses directly related t o this contract. The terms of the agreement are as follows 1. City shall be compensated on the basis of salary cost times a multiplier. Salary cost is defined as the salary payment plus medicare and unemployment compensation insurance. 2. Actual out-of-pocket expenses incurred during the performance of this Agreement shall be reimbursed at City's cost plus ten percent (10%). The actual out-of-pocket expenses including but not limited to, mileage charges, parking tolls, telephone, postage, printing and reproduction costs, and other miscellaneous costs incurred specifically f or this Agreement. 3. City shall be paid within seven (7) working days of the date of the statement, on the basis of statements prepared by City based upon the hours worked pursuant to this Agreement t ogether with reimbursable costs. The statements to District shall be verified by the MBE/WBE Coordinator and payment will be subject to certification by the District. Although this agreement will increase the MBE and WBE vendor base for the City indirectly, it will specifically provide services and expertise which the District cannot presently provide with their in-house staff. The attached contract will be presented t o the FWISD Board on March 10, 1987 at their reyular meeting. Upon approval of the contract in the exact form presented to the City Council by the FWISD Board, the City Manager, or his duly authorized representative, will execute the agreement.
