RECOMMENDATION
--It is recommended that an ordinance be adopted rescinding the assessments
-~ against the properties zoned and used as single family or duplex residential
property on Andrew Street from Willie to Elgin and declaring such assessments
to be null and void.
BACKGROUND
On June 9, 1987 (M&C G-7049), the City Council adopted Ordinance No. 9889
closing the benefit hearing for the reconstruction of Andrew Avenue from Willie
Street to Elgin Street and levying the proposed assessments.
On July 28, 1987 (M&C G-7160), the City Council adopted revisions to the
Assessment Paving Policy whereby no assessments will be levied for one- and
two-family residential property for both new construction and reconstruction in
CDBG qualifying areas so long as CDBG funds are available to finance 30 percent
of the cost of new construction and 15 percent of the cost of reconstruction.
The revised policy is applicable to all streets within the 1986-88 Capital
Improvement Program.
Andrew Street is listed in the 1986-88 Capital Improvements Program and is
located in the Stop Six Special Emphasis Area. As such, it qualifies for the
assessment exemption for residential property.
