AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN
THE AMOUNT OF $87,265 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
EXECUTING AN ENGINEERING AGREEMENT WITH LOPEZGARCIA GROUP,
INC., FOR THE COOKS-EDVERVILLE CULVERT EROSION PROTECTION
PROJECT (CITY PROJECT NO. 00667); PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Storm Water Capital Projects Fund in the amount of $87,265 from available
funds, for the purpose of executing an Engineering Agreement with LopezGarcia Group, Inc., for
the Cooks-Ederville Culvert Erosion Protection Project (City Project No. 00667).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
ADOPTED AND EFFECTIVE: January 15, 2008
This ordinance shall take effect upon adoption.

Authorize Execution of an Engineering Agreement with LopezGarcia Group, Inc., for the Cooks-
Ederville Culvert Erosion Protection Project (Project No. 00667) and Adopt Appropriation Ordinance
RECOMMENDi4TION:
It is recommended that the City Council:
1. Authorize the transfer of $87,265 from the Storm Water Utility Fund to the Storm Water Capital Projects
Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Storm Water Capital Projects Fund in the amount of $87,265; and
3. Authorize the City Manager to execute an engineering agreement with LopezGarcia Group, Inc., in the
amount of $75,883 for the Cooks-Ederville Culvert Erosion Protection Project.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve
streams, minimize water pollution and to operate the storm water system in a more effective manner to fully
comply with state and federal regulatory requirements. This will be accomplished by infrastructure
reconstruction and system maintenance, master planning, enhanced development review, and increased
public education and outreach.
The Culverts at Cooks-Ederville Road have experienced severe erosion downstream of the concrete apron
or riprap which is undermining the concrete and will eventually cause it to fail.
The scope of this agreement consists of the preparation of a drainage study for the future erosion protection
improvements for the two culverts.
LopezGarcia Group, Inc., proposes to perform the necessary work far a lump sum fee of 75,883. City Staff
considers this to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $11,328 is required by the Engineering Department for project
management.
M/WBE -LopezGarcia Group, Inc., is in compliance with the City's M/WBE Ordinance by committing to 24
percent M/WBE participation. The City's goal on this project is 19 percent.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Storm Water Capital Projects Fund.
