ORDINANCE NO. ORDINANCE ACCEPTING IM2RCVEMTTS ON A PORTIONS OF RIVERSIDE DRIVE, HUFF11N STRK17,T AND BOOKER STREET IN THE CITY OF FORT WORTH, TEXAS: DECLARING THE CONTRACT WITH TEUS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROVMWTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDMTCE OF SPECIAL ASSESSYMTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOIM AGAINST SOME OF SAID ASSESSYINTS: DIRECTING THE CITY SECRETARY TO ZXROSS AND MTROLL !H 13 ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND By FILING 722 COMPLETE OPDINA1_qCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY: AND PROVIDING AY EFFECTIVE DATE. 11HEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas 3itulithic Company for the making and construction of certain street improvements on the hereinafter described portions of streets in said city, to unit: 1. Riverside Drive From the northerly line of Lot 34, Lincoln Place Addition to the southerly line of East First Street, known and designated as Unit No. 2. 2. Huffman Street From the easterly line of Retta Street to the westerly line of Riverside Drive, known and designated as Unit No. 3. 3. Booker Street From the easterly line of Retta Street to the westerly line of Riverside Drive, known and designated as Unit No. 4. WTHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4537, a portion of the cost of said improvements was levied and assessed against the respective properties abut- ting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4537, and, WH.M1, EAS, the street improvements hereinabove mentioned have been com- pleted upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOSE, THEREFORE, BE IT ORDAINED BY THE CITY COMTCIL OF THE CITY OF FORT WORTH, TMS, THAT: 1. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. IIs The Mayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the cor— porate seal of the City, all in accordance with the proc-eedings relating to such improvements and assessments. The certificates shall be numbered, shall dece-ribe the property against which the assessment has been levied, shall where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: 2 III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Texas Bitulithic Company as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by Filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED THIS day of 19 .
