HomeMy WebLinkAboutOrdinance 6029 ORDINANCE NO. AN ORDINANCE PROVIDING THAT PORTIONS OF THE RIGHTS OF WAY OF THE NORTH AND SOUTH FRONTAGE ROADS OF U. S. HIGHWAY 80 WEST IN THE HAVES COVINGTON SURVEY, ABSTRACT NO. 256, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1. That the following described tracts of land be and the same are hereby closed, abandoned and permanently vacated as rights of way or public thoroughfares of any kind or char- acter whatever, save and except that easements are reserved for any and all existing or future utilities : Portions of the rights of way of the North and South Frontage Roads of U. S . Highway 80 West in the Hayes Covington Survey, Abstract No. 256, Tarrant County, Texas , particularly described as follows : TRACT NO. 1 BEGINNING at thb easternmost northeast corner of Tract "L" as recorded in Volo 4480, page 45 , of the Deed Records of Tarrant County, Texas ; THENCE north 89 degrees 00 minutes west, 174. 20 feet along the north line of Tract "L" , to an iron pin; THENCE north 00 degrees 33 minutes east, 45.0 feet to an iron pin; THENCE south 89 degrees 00 minutes east, 182.82 feet to an iron pin in a curve, with a radius of 380 . 38 feet; THENCE along curve in a southerly direction 45 .87 feet to the point of beginning, containing .184 acre more or less . SECTION 3 ® That all ordinances or parts of ordinances in conflict herewith are hereby repealed® SECTION 4® That this ordinance shall take effect and be in full force and effect from and after the date of its passage. S. Highway 1 12/2/68 PZ-308 80 West 1 of R,&B, R MAHONEY V� DY Richardson Heights, Inc. , and Western Hills Development Corp. , have requested H the City to vacate 45 feet of the surplus portions of the frontage road rights-of-way in the 8400 through 8600 blocks, north and south sides of U. S. Highway 80 West. This request is made to permit the vacated rights- of-way to be incorporated into adjoining land owned by the applicants. The areas requested to be vacated are for five tracts of land, being portions of the rights-of-way of the North and South Frontage Roads of U. S. Highway 80 West in the Hayes Covington Survey, Abstract No. 256, Tarrant County, Texas. These portions of the frontage road rights-of-way are not open, paved or guttered. The existing 282 feet of right-of-way is much greater than is needed since the opening of I-20; therefore, the subject rights-of-way are excess and the remaining 192 feet is all that will be required in the future. The City departments and private utility companies have reviewed this request. They have no objection to the vacations provided the applicants plat the vacated rights-of-way with their adjoining properties and provided all the vacated rights-of-way are retained as easements for existing and future utilities. The City Plan Commission has reviewed the proposed vacation and recommends adoption of an ordinance vacating the rights-of-way, subject to the applicants' platting the vacated rights-of-way with their adjoining properties and retaining the vacated rights-of-way as easements for existing and future utilities. A plat which includes the vacated rights-of-way and which also provides the necessary easements has been filed with the Planning Department. Recommendation It is recommended that an ordinance be adopted cloling the subject rights-of- way as recommended by the City Plan Commission. HDM:ms Attach.
