AN ORDINANCE AMENDING CHAPTER 4 OF EXHIBIT "B" OF THE PLUMBING CODE OF THE CITY OF FORT WORTH, SAID ORDINANCE CONCERNING CERTAIN DRAINAGE SYSTEM MATE- RIALS; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES AND PRO- VISIONS OF THE PLUMBING CODE OF THE CITY OF FORT WORTH; REPEALING ALL ORDINANCES OR PROVISIONS OF THE PLUMBING CODE OF THE CITY OF FORT WORTH IN CON- FLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVID- ING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : m SECTION 1. That Paragraph (3) of Subsection (a) of Section 401 - "Materials" of Chapter 4 - "Drainage Systems" of Exhibit "B, " attached to and incorporated by reference in the Plumbing Code of the City of Fort Worth, be and the same is hereby amended and, after being so amended, shall hereafter read as follows : " (3) Underground drainage systems of ABS andPVC when under a floor slab no deeper than six (6) feet, and Bituminized Fibre Pipe shall be encased in reinforced concrete. Said concrete shall encase the pipe with a minimum of four (4) inches around the outside diameter of the pipe. The radius shall be four (4) inches plus the radius of the pipe. Reinforcing shall be four (4) three-eighths- (3/8) -inch diameter steel bars laid parallel to the pipe, with two (2) bars placed under the pipe and two (2) bars placed over the pipe. " SECTION 2 . That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3 . That this ordinance shall be and is hereby declared to be cumulative of the provisions of the Plumbing Code of the City of Fort Worth and amendments thereto, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, equipment, use and maintenance of plumb- ing and drainage systems for buildings and structures in the City of Fort Worth, except in those instances where the provi- sions of this ordinance are in direct conflict with such Code, in which instances said conflicting provisions of such Code are hereby repealed. SECTION 4. That all pending litigations and existing violations, both civil and criminal, whether pending in court or not, under the Plumbing Code of the City of Fort Worth and amendments thereto superseded by this ordinance shall not be affected by this ordi- nance but may be prosecuted until final disposition by the Courts. SECTION 5. That any person, firm, association of persons, company or corporation or their agents, servants or employees who violate, disobey, omit, neglect or refuse to comply with any provision of this ordinance shall be punished by a fine of not to exceed two hundred dollars ($200.00) , and each day that a violation exists is hereby declared to be a distinct and separate offense and punishable as such, all as provided for in Section 1-5 of Chapter I of the Code of the City of Fort Worth (1964) , as amended. SECTION 6 . That this ordinance shall become effective and be in full force and effect from and after its passage and publication, as required by law, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: City Attorney ADOPTED EFFECTIVE: -3- City of Fort Worth, Texas uNt pOaBg Mayor and Council Communication DATE REFERENCE SUBJECT: Proposed Revisions to Plumbing PAGE NUMBER PAIGE 10/2/72 G-2072 Code - Extended Use of Plastic 1 I Pipe of On June 19, 1972, the City Council adopted Ordinance No. 6684 incorporating various revisions into the Plumbing Code, including provisions for the use of bituminized fiber and plastic pipe for house sewers. This ordinance specified that all underground drainage systems of nonmetallic piping must be encased in reinforced concrete. The Department of Housing and Urban Development has advised the staff that this requirement must be modified slightly to permit recertification of the Workable Program. There- fore, it is proposed that the Code be amended to require encasing plastic pipe in concrete only when such pipe is under a floor slab no deeper than six feet. Recommendation It is recommended that an ordinance be adopted revising the Plumbing Code to require that plastic pipe be encased in concrete only when the pipe is under a floor slab no deeper than six feet.
