AN ORDINANCE PROVIDING THAT THE FOLLOWING POR- TIONS OF MORPHY STREET BE VACATED, ABANDONED AND CLOSED: FROM HEMPHILL STREET EASTWARD TO THE WEST RIGHT-OF-WAY LINE OF THE NORTH-SOUTH ALLEY IN BLOCK 2/23 OF FIELDS-WELCH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND FROM THE EAST LINE OF THE NORTH- SOUTH ALLEY IN SAID BLOCK 2/23, FIELDS-WELCH ADDITION, EASTWARD TO SOUTH JENNINGS AVENUE; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following portions of Morphy Street be and the same are hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character what- ever, save and except that easements are reserved for any and all existing utilities: Morphy Street from Hemphill Street east- ward to the west right-of-way line of the north-south alley in Block 2/23, Fields-Welch Addition to the City of Fort Worth, Tarrant County, Texas; and Morphy Street from the east line of the north-south alley in Block' 2/23 of said Addi- tion eastward to South Jennings Avenue. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portions of the street is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Morphy Street (V-73-36) 1 of 1 "LKES BILA DI KIMBRA John J. Cassata, Bishop of the Diocese of Fort Worth, and DAVIS Michael G. Smith, owners of all abutting property, have requested that the City vacate Morphy Street from Hemphill Street east to South Jennings Avenue, but not to include the abandonment of the intersecting north-south alley, as shown on the attached map. The subject right-of-way, acquired by dedication, is open to vehicular traffic, but is not paved. There are also existing utilities lo- cated therein. The reviewing City departments and private utility companies have no objections to this requested street vacation provided the east portion of the vacated right-of-way between the alley and South Jennings Avenue is retained as a utility easement, the west por- tion between the alley and Hemphill Street is retained as an access and utility easement, the existing north-south alley is continued by dedication across the vacated right-of-way and the vacated right-of-way is replatted with adjoining property. The City has received a satisfactory replat and the City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested, Recommendation: It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
