AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
EXEMPTING FROM AD VALOREM TAXES A PERCENTAGE OF THE
APPRAISED VALUE OF A PERSON'S RESIDENCE HOMESTEAD AND
DECLARING AN EFFECTIVE DATE .
WHEREAS, Article 8, Section 1-b, Subsection (e) of the Texas
Constitution permits a city to exempt from ad valorem taxation a
percentage of the appraised value of the residence homestead of a
married or unmarried person, including one living alone, provided
that such exemption may not exceed 30 percent in the tax year 1987
and 20 percent in the tax year 1988 and each subsequent tax year;
and
WHEREAS, the amount of the exemption authorized pursuant to
such provision may not be less than $5000; and
WHEREAS, it is the desire of the City Council to authorize such
a residence homestead exemption;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECT ION I .
Twenty percent of the appraised value of the residence home-
stead of a married or unmarried person, including one living alone,
is hereby exempted from ad valorem taxes levied by the City for the
tax year 1987 and each subsequent tax year. If the exemption autho-
rized by this section produces an exemption of less than five
thousand dollars when applied to a particular residence homestead,
the person shall be entitled to an exemption of $5,000 of the ap-
praised value. A person who is eligible for an exemption under this

section shall also be entitled to receive other applicable exemp-
bons provided for by law, including an additional residence home-
stead exemption for persons sixty-five years of age or older where
applicable.
SECT ION I I .
Should any part, portion, section or part of a section of this
ordinance be declared invalid or inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way affect the remaining portions, parts,
sections or parts of sections of this ordinance, which provision
shall be, remain and continue to be in full force and effect.
SECTION III.
This ordinance shall take effect upon its passage. The exemp-
tion shall apply to ad valorem taxes levied by the City for the tax
year 1987 and each subsequE~nt tax year unless changed by the--City
Council or by state Taw. --

Recommendation•
It is recommended that the attached ordinance be adopted establishing a 20
percent residence homestead tai; exemption for the tax year 1987 and all subse-
quent tax years until amended by the City Council
Background•
Article VIII, Section 1-b, 'Subsection (e) of the Texas Constitution and
Section 11.13(n) of the Tax Cocie permit a city to exempt from ad valorem taxes
a percentage of the appraised value of the residence homestead of a married or
unmarried person. If the percentage of the exemption produces an exemption of
less than $5,000, the individual is entitled to an exemption of $5,000 The
percentage of the exemption may not exceed 30 percent for the 1987 tax year and
20 percent for the tax years o1= 1988 and beyond.
In the 1986 tax year, the City Council granted a 20 percent residence homestead
exemption Persons receiving this exemption are also eligible for other appli-
cable exemptions, including any additional homestead exemption for persons
sixty-five years or older
Attached is an ordinance which would continue the residence homestead tax
exemption at the 20 percent level for' the 1987 tax year and all subsequent tax
years unless amended by the Cii:y Council or changed by state law
