AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING PEAR CREEK CIRCLE, A PUBLIC STREET AND RIGHT-OF-
WAY LOCATED IN THE LOST CREEK ADDITION TO THE CITY OF FORT
WORTH, TEXAS, SAID PUBLIC STREET AND RIGHT-OF-WAY BEING
MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVER-
SION OF FEE TN SAID LAND; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the public street and right-of-way known as Pear Creek
Circle located in Block 12 of the Lost Creek Addition, recorded in
Volume 388-123, Page 4 of the Plat Records of Tarrant County, TEXAS,
said public street and right-of-way being more specifically d e-
scribed in Exhibit "A" which is attached hereto and incorporated
herein by reference for all purposes, be and the same is vacated,
abandoned and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated public
street and right-of-way is hereby released and shall revert to the
adjacent owner as provided by law, SAVE AND EXCEPT that easements
are retained for any and all existing and prospective utilities and
any and all existing and prospective drainage requirements, as
necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Being a portion of a 50' wide street right of way known as Pear
Creek Circle situated in Block 12, Lost Creek Addition, according
to the plat filed of record in volume 388-123, page 4, Plat Records,
Tarrant County, Texas, and being more particularly described by metes
and bounds as follows:
BEGINNING at a point being the intersection of the south line of Pear
Creek Circle with the west line of Lost Creek Boulevard; said point
also lying North 1,953.60 feet and East 1,336.23 feet from the south-
west corner of the C. E. $urk:ham Survey, Abstract No. 246;
THENCE S 56° 47' 45" W, 243.29 feet to a point for a corner;
THENCE N 42° 14' 15" W, 387'.03 feet to a point for a corner;
THENCE N 56° 45' 45" E, 50..62 feet to a point for a corner;
THENCE S 42° 14' 15" E, 336.43 feet to a point for a corner;
THENCE N 56° 47' 45" E, 182.43 feet to a point for a corner;
THENCE S 53° 12' 15" E, 53.21 feet to the POIN T OF BEGINNING, and

It is recommended that the City Council adopt an Ordinance vacating Pear Creek
Circle (50 foot right-of-way) and a :L5 foot x 120 foot utility easement, both
located in Block 12, Lost Creek Addiiton, as recorded in Volume 288-123, Page
4, P.R.T.C.T., as recommended by the City Plan Commission.
Discussion•
ErniT Freiwald, on behalf of West shire Properties, Inc.., owner of the abutting
property, with consent of all abuttiing owners, has !requested that the City
vacate the above described street right-of-way and utility easement, as shown
on the attached map.
The subject street right-of-wa,y and ut;l;ty easement, acquired by dedication,
are not open on the ground, but contaiins a sewer utility facility. The subject
vacation request is made in order t:o replat the vacated right-of-way with
adjacent property, to expand i:he building area, and provide more usable yard
space.
The Land Agent is not charging a fE~e, since the applicant will dedicate a
reel aceanent roadway in place of the vacated right-of-way, which in effect
equals a land swap of equal value.
Reviewing City departments and private utility companies have raised no
objections to this request, subject to the vacated right-of-way being replatted
with adjacent property, and any required utility easement being retained. A
satisfactory replat has been submitted. APPROVED BY
