AN ORDINANCE AMENDING CHAPTER 27, ARTICLE II OF THE CODE
OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, PRO-
VIDING FOR THE PAYMENT OF ASSIGNMENT PAY FOR PERFORMANCE
OF SPECIALIZED FUNCTIONS WITHIN THE POLICE DEPARTMENT;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVID-
ING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT OF THIS ORDINANCE; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Chapter 27, Article IT of the Code of the City of Fort
Worth, Texas (1986), as amended, is further amended by adding
Section 27-28 under Article II, which section shall read as follows:
Sec. 27-28. Assignment Pay; Bilingual Personnel
The Chief of Police may designate certain police
officers and civilian employees in the Police Department
as "bilingual personnel" who, in addition to their regular
duties, will perform certain specialized functions and be
paid the sum of $25.00 per month as assignment pay. Such
payment shall be in addition to the employee's regular
pay.
"Bilingual personnel" means a member of the Police
Department who, in the performance of the member's duties,
is capable of effectively translating Spanish into English
and English into Spanish, orally and/or in writing.
In order to be eligible for assignment pay as "bi-
lingual personnel", the employee must pass a Spanish .
proficiency test to be administered by the Personnel
Department.

SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such

unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
Sections 1 and 5 in the minutes of the City Council and by filing
the ordinance in the ordinance records of the City.

SECTION 5.
This ordinance shall take effect and be in f ull force and
effect from and after its passage, and it is so ordained.

That the attached amendment amending Chapter 27, "Police" of the Code of the
City of Fort Worth, Texas (1986), as amended, providing for the payment of assignment
pay for use of verbal bilingual skills within the police department be approved effective
April 27, 1,.987.
Background
The Police and Fire Civil Service Act (Article 1269m, Vernon's Annotated Civil Statutes
of Texas) permits the City Council to authorize assignment pay for police officers
performing specialized function:> in their department. The amount of assignment
pay and the criteria for payment: of assignment pay must be established by ordinance
and is in addition to the police officer's regular pay. such an ordinance may set criteria
that provides for payment only to a police officer in a special assignment.
At the request of the Police Chief, an amendment to Chapter 27, "Police" establishing
bilingual assignment pay for using specialized skills within the police department
has been prepared by the Department of Law for City Council consideration; the
amendment has. been reviewed by the Personnel Department and City Manager's Office.
The attached amendment permits the Police Chief to designate positions which require
the use of bilingual skills.
Informal Report No. 7082 outlines the specialized functions of a bilingual police
employee in the Police Department. The employees serving in designated positions
shall receive assignment pay as defined in Informal Report No. 7082.
Funding is available in the Police Department Administrative Services Bureau Account
No. 35-20-00, Index Code 260836.
