ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE 30' WIDE STORM DRAINAGE EASEMENT A LENGTH
OF 214' FROM THE EAST LINE OF A 5' UTILITY
EASEMENT ALONG THE REAR OF LOTS 3 AND 4 EAST-
WARD TO THE WEST RIGHT-OF-WAY LINE OF TIMBER-
LINE DRIVE SOUTH ALONG THE COMMON LINE OF LOTS
3 AND 4, D. ROBERTSON SUBDIVISION; PROVIDING
FOR THE REVERSION OF THE FEE IN SAID LAND; RE-
PEALING ALL ORDINANCES IN CONFLICT HEREWITH
AND PROVIDING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That the hereinafter described portion of the 30' wide
storm drainage easement a length of 214' from the East line
of a 5' utility easement along the rear of Lots 3 and 4, east-
ward to the West right-of-way line of Timberline Drive South
along the common line of Lots 3 and 4, D. Robertson Subdivision,
be and the same is hereby extinguished, vacated, closed and per-
manently abandoned as a storm drainage easement.
SECTION 2.
That the fee to the land in the storm drainage easement
hereinabove described is hereby released and will revert to
the adjacent owners as provided by law, save and except that
easements are retained and reserved for any and all existing
utilities.
SECTION 3.
All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

M. J. Buhl, owner of Lot 4, with consent of Lucius R. Degrate, owner
of Lot 3, D. Robertson Sub. , has requested that the City vacate the
30 ft. wide storm drain easement a length of 214 ft. from the east
line of a 5 ft. utility easement along the rear of Lots 3 & 4 east-
ward to the west right-of-way line of Timberline Drive South along
the common line of Lots 3 & 4, D. Robertson Sub. , as shown on the
attached map.
This easement, acquired by dedication, is not in use; the drainage
has been relocated elsewhere.
Reviewing City Departments and private utility companies have no
objections to abandonment of the subject easement.
Recommendation
It is recommended that an ordinance be adopted vacating subject
easement.
