I `r L 9 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EAST FIRST STREET , AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH J_i._BERTRAM CONST. & ENG., INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with J. L. Bertram Construction & Engineering, Inc. , for the making and construction of certain street improvements ona hereinafter described portions of streets, avenues and public places in said City, to- it: UNIT 1: EAST FIRST STREET From I.H.121 Service Road to 1200' east, known and designated as Project No. 104-24000-248, Unit 1. 72- 9 � WHEREAS,-by sundry proceedings heretofore ,passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 7296 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 7298 P and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and perfoamed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro— perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificatesp together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED THIS 18th day of October , 19-7-6 _. Project Description Name: Assessment Paving and Storm Drain Mastin Industrial Park, Project No. 104-24000-248 Contractor: J. L. Bertram Construction and Engineering, Inc. Contract Awarded: January 5, 1976 (M & C C-3291) Work Order Issued: February 25, 1976 Work Order Effective: March 8, 1976 Work Began: March 8, 1976 Project Substantially Complete and Final Inspection: August 31, 1976 Date of Final Approval: September 22, 1976 Working Time Bid: 70 Working days Working Time Used: 66 Working days Project Cost and Financing Original Bid Price: $136,712.95 Change Order No. 1: - 5,269.21 ( M & C C-3291) No. 2: + 4,465.00 ( M & C C-3419) Revised Bid Price: $135,908.74 Final Contract Cost: $131,239.53 Partial Payment Previously Made: 5, Amount $118,217.66 Final Payment Due: $13,021.87 Sufficients funds are available for the final payment to be made from Project Number 104-24000-248. Deviation from Bid Price: The final contract cost of this project is $4,669.21 under the revised bid price. A major portion of the savings resulted because it was not necessary to construct subdrains as anticipated (-$792.00) and considerably less utility adjustments were necessary than estimated ( -$2,295.74) resulting in a savings of $3,087.74. The work also required less seven inch concrete paving then estimated in the contract specifications effecting a savings of $1,695.36. The remaining cost difference, + $113,89, is attributed to minor variations between quantities estimated in the contract specifications and quantities measured and used at the job site. Recommendations It is recommended that the project described be accepted by the adoption of an ordinance and final payment of $13,021.87 be made to J. L. Bertram Construction and Engineering Inc.
