AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A UTILITY EASEMENT LOCATED IN THE LOST CREEK
ADDITION TO THE CITY OF FORT WORTH, TEXAS, SAID EASEMENT
BEING MORE SPECIFICALLY DESCRIBED HEREIN; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the utility easement located in Block 12 of the Lost Creek
Addition to the City of Fort Worth, Texas, as recorded in Volume
388-123, Page 4 of the Plat Records of Tarrant County, Texas, said
easement being more specifically described in Exhibit "A" which is
attached hereto and incorporated herein by reference for all pur-
poses, be and the same is vacated, abandoned and permanently closed
and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

DESCRIPTION OF°EASE~IENT ABANDONMENT
Being a portion of a 15' wide easement platted in Block 12, Lost Creek
Addition according to the plat filed of record in volume 388-123,
page 4, Plat Records, Tarrant County, Texas, and being more particu-
larly described by metes and bounds as follows:
BEGINNING at the most southern corner of said 15° easement where it
commences in a northwesterly direction from a 50' wide street right
of way known as Pear Creek Circle; said point also being North 2,112.78'
and East 881.46 ' from the southwest corner of the C. E. Burkham
Survey, Abstract No. 246;
THENCE N 42° 14' 15" W, 106.44 feet to a point for a corner;
THENCE N 60° 22' 08" E, 15.33 feet to a point for a corner;
THENCE S 42° 14' 15" E, 105.46 feet to a point for a corner;
THENCE S 56° 45' 45" W, 15.15 feet to the POINT OF BEGINNING and
containing approximately 1,590 square feet of land, more
or less.

Recommendation•
It is recommended that the City Council adopt an Ordinance vacating Pear Creek
Circle (50 foot right-of-way) and a 15 foot x 120 foot utility easement, both
located in Block 12, Lost Creek Addiiton, as recorded in Volume 288-123, Page
4, P.R.T.C.T., as recormended by the City Plan Commission.

Emil Freiwald, on behalf of Westshire Properties, Inc., owner of the abutting
property, with consent of all abutting owners, has requested that the City
vacate the above described street right-of-way and utility easement, as shown
on the attached map.
The subject street right-of-way and utility easement, acquired by dedication,
are not open on the ground, but contains a sewer utility facility. The subject
vacation request is made in order to replat the vacated right-of-way with
adjacent property, to expand the building area, and provide more usable yard
space.
The Land Agent is not charging a fee, since the applicant will dedicate a
replacement roadway in place of the vacated right-of-way, which in effect
equals a land swap of equal value
Reviewing City departments and private utility companies have raised no
objections to this request, subject to the vacated right-of-way being replatted
with adjacent property, and any required utility easerent being retained. A
satisfactory replat has been submitted APPROVES BY
