ORDINANCE ACCEPTING IMPROVE~IIIV'I'S ON A PORTION OF COOKS LANE UNIT
III AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC
PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CON'T'RACT
WITH J. L. BERTRAM CONSTRUCTION AND ENGINEERING INC. FOR THE
CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERF'ORMID;
DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN
EVIDENCE OF SPECIAL AS5ESSMENTS.LEVIED AFTER GIVING EFFECT TD
SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID
ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL
THIS ORDINANCE BY COPYING THE CAFrION OF SAME IN THE MINUTE BOOK
OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE
COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a
contract with J. L. BERTRAM CONSTRUCTION AND ENGINEERING INC. for the making and
construction of certain street improvements on the hereinafter described portions of
streets, avenues and public places in said City, to-wit:
COOKS LANE From I.H. 30 to John T. White Road, known
(UNIT III) and designated as Project No. 30-023171-00,
Unit III, a seven-inch thick reinforced
concrete pavement with a seven-inch high
attached concrete curb on a six-inch thick
lime stabilized subgrade, so that the
finished roadway will consist of two
thirty-six feet wide traffic lanes with a
twenty-eight foot wide median. Seven-inch
thick reinforced concrete turn lanes and
six-inch thick concrete driveway approaches
will be constructed where required.

W~REAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 9720 a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public paces and
against the real and true owners thereof; and,
WE3EREAS, the City Council of the City of Fort Worth, Texas, has, upon
review, found and determined that, in some instances, in order to effect substantial
justice and equality, it is desirable and necessary to grant and issue certain credits
against some one or more of the assessments levied by Ordinance No. 9720 , and
W~REAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract
therefore;
NOW, THEREFORE,
BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT;
I.
The improvements on each of the portions of street, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and
performed.
II .
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against
abutting property and the owner thereof for such improvements, and the City Secretary
is directed to attest same and impress thereon the corporate seal of the City, all in
accordance with the proceedings relating to such improvements and assessments. The
certificates shall be numbered, shall describe the property against which the
assessement has been levied, shall, where known, state the name or names of the true
owners of the respective parcels of property assessed and shall be issued in an amount
equal to the difference between the principal amount of the assessment and the amounts
of any credit issued thereon. The numbers of the certificates, with the property
descriptions to be shown on the respective certificates, together with the names of
the owners of said property, the principal amount of the assessment, the respective
credits, if any which are hereby authorized, granted and allowed against the principal
amount of some one or more of the assessments heretofore levied, and the principal
amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City,Secretary is.hereby directed to engross, and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth,
Texas, and by filing the complete ordinance in the appropriate Ordinance Records of
said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.
