OF THE CODE OF THE CITY OF FORT _ WORTH (1986), AS AMENDED, BY CHANGING FEES FOR PROVISION OF CERTAIN WRECKER SERVICES; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND EN- ROLLMENT; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 34-187(e) (6) of Article V of Chapter 34 of the Code of the City of Fort Worth be amended by changing sub- sections (a), (b), (c), (e), (f), and (g) thereof, to read as follows: "a. Towage A charge up to a maximum of forty-five dollars ($45.00) for towing such vehicle from one point on a street to another location within the corporate limits of the city as designated in writing by the owner of the vehicle or by the police department at the place where the tow originated." "b. Extra work. An additional charge of forty dollars ($40 00) an hour~for removing vehicles which are off the street right-of-way, such charge to be made from the time the operator begins to remove the vehicle until it is on the traveled portion of the street. Even though the vehicle is within the street right-of-way, an additional charge may be made if the car is located in some unusual condition within the right-of-way, such as but not limited to, a river or creek fed or a ditch of P7 f4. greater depth than an ordinary bar ditch. For fee calculation, fractions of an hour may not be considered a full hour; one-quarter of any hour shall be the smallest fraction permitted for such calculation." "c. Tandem axle wreckers. An additional charge of eighty-five ($85.00) per hour for the use of a heavy duty (tandem axle) wrecker. No heavy duty (tandem axle) wrecker shall be used unless such use is approved by a police supervisor at the scene of the pull." '._'e. Use of a dolly. An additional charge of twenty-five dollars ($25.00) when the use of a dolly is necessary for towing any such vehicle." "f. Use of a car carrier. maximum of sixty-five when the use of a car for t-owing any such v. may only be used when supervisor." A charge up to a dollars ($65.00) carrier is necessary :hicle. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (198b), :Y r i as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed.. SECTION 3 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sec 1 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City.. ~~~" 'r. iF .. . .~. The last revision t o the ordinance was in April of 1982. The previous change was in Septembr of 1977. Staff has reviewed the recommendation of the Greater Fort Worth/Tarrant County L•drecker Association and has surveyed fees charged by other major cities in the State of Texas. Therefore, it is the recommendation of staff that the following changes be made. ~ ~ 1. Towage Fee - From X35 to 5~ ~ 2. Extra Labor - From X30 to $~~'~ ' 3.
