AN ORDINANCE APPROPRIATING THE SUM OF $1,054,178 FROM WATER AND SEWER OPERATING FUND N0. 45, UNAPPROPRIATED RETAINED EARNINGS, TO THE 1986-87 WATER AND SEWER FIELD OPERATIONS, VARIOUS ACCOUNTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDI- NANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase., clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases., clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation+ in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -2- .~ 4' SECTION 5. Background• During the 1985-86 budget preparation process, provisions were made for a portion of the street maintenance activities normally performed by City crews to be contracted out to private contractors. This procedure is continuing in Fiscal Year 1986-87. The Transportation and Public Works Department currently is proposing change orders to the City Council that will extend and increase the Olmos Equipment Company contracts. It is proposed that the Northeast area Contract No. 15338 be extended 60 days, until July 17, 1987, and increased by $59,680 and that the Southwest area Contract No. 15340 be extended 60 days and increased by $74,200. In addition to the proposed change orders to the 01mos Equipment Company contracts, the Transportation and Public Works Department also is recommending that the City Council award two new utility cut repair contracts to the Austin Road Company. The proposed new Austin Road contract for the Southwest area of Fort Worth will be for $542,043, the contract for the Northeast Area will be for $378,254.55. Financing: Since utility cut repair costs are significantly exceeding budgeted amounts, it is necessary that a supplemental appropriation of $1,054,178 be made from the Water and Sewer Operating Fund 45 Unappropriated Retained Earnings to the account numbers listed below to fund the proposed change orders and new contracts.
