HomeMy WebLinkAboutOrdinance 9875.- ~ r ~,, % `~'~ :; :; ,~ ~,~.:-,r ORDINANCE N0. ~l __.~~ AN ORDINANCE AMENDING THE ASSESSMENT ROLLS IN ORDINANCE N0. 9676, PERTAINING TO THE ASSESSMENTS ON U.S. HIGHWAY 80 WEST, BETWEEN IRENE AND KAREN STREETS, AND ALSO ON STATE HIGHWAY 183, FROM 250 FEET NORTH OF RUBY STREET TO CALMONT. WHEREAS, Ordinance No. 9676 c~as adopted by the City Council and engrossed and enrolled as an ordinance of the City of Fort Worth on July 15, 1986, subsequent to the benefit hearing of the same date levying the assessments on U.S. Highway 80 West from Irene Street to Karen Street and on State Highway 183 from 250 feet north of Ruby Street to Calmont Street. Ordinance No. 9676 contained various clerical errors in the amount of the assessments levied against property adjacent to Highway 80 West. The errors in said ordinance inaccurately reflect the action taken by the City Council at the benefit hearing and the testimony presented to it in support of. the assessments; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 9676 be and is hereby amended, such that the assessment rolls for the portion of the project known as U.S. Highway 80 West, Unit I, from Irene Street to Karen Street, which appear as numbered pages 1 through 20 in Ordinance No. 9676 are hereby replaced and superseded by the assessment rolls attached to this ordinance. The rolls attached hereto reflect the action taken •- , ~. r ,~„~; ~ ,, ~A by the City Council at the benefit hearing on July 15, 1986, in levying the assessments on Highway 80 West, between Irene and Karen Streets. In all cases in which a change appears, the assessments have been reduced from any inaccurate amounts appearing in Ordinance No. 9676. The assessment rolls incorporated into Ordinance No. 9676 re- flecting the assessment levied for the paving and improvement of Highway 183 from 250 feet north of Ruby Street to Calmont Street are hereby ratified along with all other portions of Ordinance No. 9676 not specifically amended or superseded by this Ordinance. One additional traveling lane in the East and West bound traffic corridor will be added within the existing right ~of-way so that the finished roadway will be a double thirty-six roadway with a twenty-three foot median. Four-3nch thick sidewalks and six~nch thick driveway approaches will be required where none existed previously and will be loacted as shown on the plans. PAGE NUMBER 9676 LEVYING ASSESSMENTS AND CLOSING 1 5-28-87 G-7089 BENEFIT HEARING 1 or---__ FROM IRENE TO KAREN STREETS The ordinance attached will amend Ordinance No 9676, adopted by the City Council on July 15, 1986 Ordinance No. 9676 levied the assessments and closed the benefit hearing on Highway 80 West from Irene to Karen Street and on Highway 183 from 250 feet north of Ruby Street to Calmont Street. The erroneous assessment rolls were incorporated into Ordinance No 9676 and were sent to the City Secretary's office prior to the benefit hearing The correct rolls, upon which the City staff's testimony at the hearing was based, were presented to the City Council at the benefit hearing; but were inadvertently excluded from Ordinance No 9676. In all cases, the erroneous amounts reflected in the assessment rolls of Ordinance No 9676 are higher than the correct amounts which were actually approved by the city Council None of the assessments, therefore, will be increased by the proposed amendment of the rolls. The erroneous amounts appeared only in relation to the assessments levied on the portion of the pro- ject described as Highway 80 West, Irene to Karen Streets.
