AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE UTILITY EASEMENT DESCRIBED MORE SPECIFICALLY HEREIN, SAID UTILITY EASEMENT LYING WITHIN THE RIDGLEA ADDITION TO THE CITY OF FORT WORTH, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE utility easement, described more specifically in Exhibit "A" attached hereto and incorporated herein by reference for all purposes, lying within Lot 8-R, Block 52 of the Ridglea Addition to the City of Fort Worth, Tarrant County, Texas, the plat of said Ridglea Addition being recorded in Volume 388-135, Page 39, Plat Records of Tarrant County, Texas, be and the same is vacated, aban- Boned, and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DISCUSSION Marlene and Bobby Dalton, owners of abutting property, have requested that the City vacate the above-described utility easement, as shown on the attached map. The subject easement, acquired by dedication, i s platted but contain no uti 1 ity facilities. The subject va cation request is made in order to utilize the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consid- eration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companie s have raised no objections to this request.
