HomeMy WebLinkAboutOrdinance 7929 ORDINANCE NO. 7 1 *'1 AN ORDINANCE PRESCRIBING THAT THE PROVISIONS OF HOUSE BILL 1060 (ARTICLE 7174A, TEXAS REVISED CIVIL STATUTES) , REGARDING THE VALUATION AND TAXATION OF QUALIFIED OPEN SPACE LAND, SHALL NOT BE IMPLEMENTED BY THE CITY OF FORT WORTH FOR THE 1979 TAX YEAR, AND NAMING JANUARY 1, 1980 AS THE EFFECTIVE DATE FOR IMPLEMENTING SUCH VALUATION AND TAXATION PROCEDURES, AS CONTAINED IN SAID STATUTE, BY THE CITY OF FORT WORTH. WHEREAS, the Legislature of the State of Texas has, by enacting House Bill 1060 (Article 7174A, Texas Revised Civil Statutes) , directed that certain open space land which is used for agricultural purposes be valued for ad valorem tax purposes by local taxing jurisdictions at a value which. will reflect its fair market value as determined by appraisal methods set forth in said statute; and WHEREAS, the valuation process for all property within the City of Fort Worth for the tax year 1979 has progressed to such an extent that implementation of the valuation methods set forth in said statute will be impossible to effect for the tax year 1979; and WHEREAS, the Legislature has, in Article 13 of said statute, authorized local taxing jurisdictions to delay implementation of such valuation processes for such land under such circumstances until the 1980 tax year; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That the provisions of Article 7174A, Texas Revised Civil Statutes, regardirig the valuation for ad valorem tax purposes of qualified open space land, as that term is defined in said statute, not be made effective as to such land located inside the corporate limits of the City of Fort Worth or implemented by the City of Fort Worth Tax Assessor-Collector until the tax year 1980, said tax year beginning on January 1, 1980. SECTION 2. That the provisions of Article 7174A, Texas Revised Civil Statutes, regarding the valuation and taxation of all qualified open space land, as that term is defined in said statute, be made effective as to the valuation and taxation of such land for the 1980 tax year and all subsequent years, as required under said statute. SECTION 3. That for the 1980 tax year and all subsequent tax years, the valuation and taxation of qualified open space land located inside the corporate limits of the City of Fort Worth, be made pursuant to the directives of the Legisl-ature as set forth in Article 7174A, Texas Revised Civil Statutes, but in no event shall any land be valued and taxed under said statute unless the owner thereof shall timely submit his application for such valuation and taxation as prescribed in said statute, and it is so ordained. House Bill 1060, as passed by the Texas Legislature, provides for the orderly implementation of the "Tax Relief Amendment." Most articles of the amendment are effective as of January 1, 1979, and there is no local option whereby such imple- mentation may be delayed. Provisions that are mandated to be effective January 1, 1979, are the exemption of intangible property, the exemption of household goods and the personal effects not used for production of income, and limited ex- emptions for residential homesteads to be applied to school taxes only. These mandated exemptions have created a considerable work load within the Tax Office and will result in a loss in revenue, not yet determined. The article providing for the assessment of agricultural land on the basis of in- come from agricultural use is not mandated for-1979, and may be delayed until January 1, 1980, upon action by the local governmental agencies. Passage of the attached ordinance is recommended due to the limited time remain- ing for completion of the Tax Rolls for 1979, as well as the estimated loss in both City and School tax revenues. The Fort Worth Independent School District is proposing a companion resolution affecting school taxes for the 1979 assessment year. Recommendation: City Council adoption of this ordinance is recommended.
